Warranty Policy

Purpose

This page explains the statutory rights and commercial warranty applicable to products sold on New kenshi, together with the conditions for making a claim.

1) Statutory Rights (Reminder – US Law)

Implied Warranty of Merchantability (UCC)

Under US law, all products must be:

  • Of satisfactory quality;
  • Fit for purpose;
  • As described.

The customer has the right to:

  • Repair or replacement of the product if it is faulty or not as described;
  • A price reduction or refund if repair or replacement is impossible or disproportionate.

These statutory rights apply within a reasonable time from delivery, depending on the nature of the defect and reasonable expectations for the product category.

Statutory remedies are provided free of charge to the customer.

Consumer Product Safety Act (CPSA)

This legislation applies where a defect makes the product unsafe or significantly reduces its expected use.

The customer may:

  • Return the product and obtain a refund; or
  • Keep the product and receive a partial refund.

2) New kenshi Commercial Warranty (Lifetime warranty)

In addition to all mandatory statutory rights, New kenshi offers a commercial warranty lasting Lifetime warranty, starting from the purchase date shown on the invoice.

What is covered

  • Manufacturing defects, such as misaligned components, assembly issues or an unstable base;
  • Abnormal degradation during indoor use, such as irregular premature discolouration without prolonged sun exposure;
  • Structural or stability issues caused by a factory assembly defect.

What is not covered

  • Outdoor use without shelter or prolonged exposure to rain, wind or direct sunlight, unless the product page expressly states that the product is suitable for outdoor use;
  • Normal wear, dust, marks or improper storage, including compression or excessive heat;
  • Incorrect cleaning, including corrosive products, solvents or water used on flocked models;
  • Drops, unauthorised modifications or damage caused by animals;
  • Products not purchased on New kenshi or claims made without proof of purchase.

These exclusions apply only to the extent that the excluded event caused or materially contributed to the issue. They do not exclude a mandatory statutory remedy where one applies.

Duration

The commercial warranty lasts Lifetime warranty from the purchase date shown on the New kenshi invoice.

Repair or replacement does not extend or renew the original commercial warranty period unless applicable law requires otherwise or we expressly agree in writing.

3) Eligibility Conditions

To claim under the commercial warranty, the following conditions normally apply:

  • The purchase was made on New kenshi;
  • The product was used properly and for its intended purpose, mainly indoors unless indicated otherwise;
  • Proof of purchase is available, such as the order number or invoice;
  • The defect is reported as soon as reasonably possible after discovery;
  • Clear photographs or videos are supplied where reasonably available and useful for diagnosis.

A procedural condition does not limit a mandatory statutory consumer right where applicable law does not permit that limitation.

4) Claim Procedure

  1. Send an email to contact@kenshiblades.com with the subject line: “Warranty – order number”.
  2. Include:
    • Your order number;
    • The purchase date;
    • A detailed description of the defect;
    • The date on which the issue first appeared.
  3. Attach, where reasonably available:
    • Wide-angle photographs or videos of the complete product;
    • Close-up photographs or videos showing the issue.

We aim to provide an initial response within 48 business hours with appropriate instructions, which may include diagnosis, provision of a replacement part, exchange or return.

This prior-contact requirement is intended to prevent the product from being sent to the wrong warehouse. It does not remove a mandatory right or remedy.

5) Solutions Provided

Subject to the applicable statutory remedy and the nature of the issue, the solutions considered may include:

  1. Repair or provision of a replacement part where reasonably possible;
  2. Exchange for an identical or equivalent product if the original model is unavailable;
  3. A price reduction, partial refund or full refund where appropriate;
  4. Another remedy required by applicable consumer law.

Transport Costs

If a claim is covered by the commercial warranty, New kenshi covers reasonable return and reshipping costs in accordance with the instructions provided by email.

If the customer incurs an authorised expense that we are required to reimburse, proof of payment should be sent to contact@kenshiblades.com together with the order number and claim reference.

A parcel returned without prior contact or to an address not provided by customer service may be delayed or refused where legally permitted.

If the issue is not covered by the commercial warranty or a statutory consumer guarantee, a cost-effective alternative may be offered, such as a replacement part, discount or preferential shipping rate.

6) Damaged Product Upon Delivery

Please report a missing or damaged product to contact@kenshiblades.com as soon as reasonably possible and, where available, include photographs or videos of the product and packaging.

We recommend reporting visible delivery damage within 48 hours so that the carrier investigation can begin promptly. This requested reporting period does not reduce or replace any longer mandatory legal claim period.

Depending on the situation and applicable law, a replacement, replacement part, repair, price reduction or refund may be offered.

The return address is not necessarily the company's registered office. The correct address will be provided by customer service after the case is opened.

7) Territorial Scope

The New kenshi commercial warranty applies to eligible orders delivered to United States, United Kingdom, Canada, Australia, New Zealand..

Mandatory statutory rights under the consumer law applicable to the United States, the United Kingdom, Canada, Australia or New Zealand apply independently of this commercial warranty.

The commercial warranty does not remove any right that continues after the commercial warranty has ended.

9) Alternative Dispute Resolution

If a warranty complaint cannot be resolved amicably, a customer may use any competent consumer authority, court, tribunal or alternative dispute-resolution body available under the law applicable to the dispute.

US consumers may consult the American Arbitration Association where its services and rules are applicable.

Use of the AAA is subject to its rules, jurisdiction and any applicable fees. Arbitration is not mandatory unless a separate valid and enforceable agreement requires it.

Other served markets

  • United Kingdom: an approved ADR provider where available and competent, or the appropriate court;
  • Canada: the competent provincial or territorial consumer affairs office, court or tribunal;
  • Australia: the relevant state or territory consumer affairs or fair trading body, court or tribunal;
  • New Zealand: the Disputes Tribunal or another competent court, tribunal or authority.

10) Additional Mandatory Consumer Rights by Market

10.1) United States

The commercial warranty applies in addition to rights and remedies available under applicable federal and state law, including any applicable express or implied warranty. The enforceability and duration of implied warranties may vary by state.

10.2) United Kingdom

The commercial warranty is additional to the consumer's statutory rights under the Consumer Rights Act 2015. Goods must be of satisfactory quality, fit for purpose and as described.

Depending on the circumstances, statutory remedies may include the short-term right to reject, repair, replacement, price reduction or final rejection. These statutory rights are not affected by the commercial warranty or by the expiry of the commercial warranty.

10.3) Australia

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

For a major failure, an Australian consumer may be entitled to choose a replacement or refund and may also claim compensation for other reasonably foreseeable loss or damage. If the goods fail to be of acceptable quality and the failure is not major, the consumer may be entitled to repair or replacement.

The commercial warranty is an additional promise and does not replace or limit the automatic consumer guarantees. Those guarantees may continue after the commercial warranty has ended, depending on what a reasonable consumer would expect from the product.

10.4) Canada

Consumer warranty rights in Canada are principally governed by the law of the applicable province or territory. Implied warranties and statutory remedies may apply independently of the commercial warranty.

The commercial warranty does not exclude any non-waivable federal, provincial or territorial right. A Canadian consumer may consult the competent provincial or territorial consumer affairs office for information about the law applicable to the purchase.

10.5) New Zealand

The commercial warranty applies in addition to the Consumer Guarantees Act 1993 and the Fair Trading Act 1986.

Goods supplied to a New Zealand consumer must be of acceptable quality, safe, durable, fit for purpose and consistent with their description. Depending on the seriousness of a failure, statutory remedies may include repair, replacement, rejection, refund or compensation.

Rights under the Consumer Guarantees Act may continue after the commercial warranty has ended. Nothing in this policy limits those rights where contracting out is prohibited.
