Terms and Conditions of Sale (TCS)

1) Scope of Application
These Terms and Conditions of Sale ("TCS") govern sales made through the website Kenshi Blades, operated by NOITAKY Matthieu, with its registered office located at 17 rue de l'Amazone, 44470 Carquefou, France.
These TCS apply to orders placed by customers for products offered through Kenshi Blades, subject to any mandatory law applicable to the customer or transaction that cannot lawfully be excluded or restricted.
Before confirming an order, the customer is given an opportunity to review the products selected, the applicable prices, delivery information and these TCS.
Where a dedicated acceptance box is displayed, the customer confirms having read and accepted these TCS before submitting payment.
The customer declares that they have the legal capacity required to enter into the transaction or are otherwise legally authorised to do so.
The version of these TCS applicable to an order is the version made available to the customer when the order is placed. Electronic records relating to the transaction, including order confirmations, timestamps, payment records, emails and invoices, may be retained as evidence in accordance with applicable law.
2) Products
Products offered for sale are described and presented as accurately and clearly as reasonably possible.
Product photographs, illustrations, dimensions, materials, colours, features and specifications are intended to represent the relevant products faithfully. Minor non-material variations may occur because of photography, screen settings, manufacturing tolerances, materials or other technical factors.
Such variations do not permit materially inaccurate or misleading descriptions.
Kenshi Blades may update its product selection and future product specifications at any time, provided that products already ordered remain subject to the description and contractual information applicable when the order was placed.
Nothing in this section limits any right arising under applicable law where goods do not correspond with their description, are not of merchantable quality, are not reasonably fit for an applicable purpose or otherwise fail to comply with a statutory condition.
3) Prices
Prices for the Hong Kong market are displayed in Hong Kong dollars (HKD) unless another currency is expressly displayed for the relevant transaction.
All prices include all taxes and compulsory charges that are required to be included in the advertised or displayed price.
Hong Kong does not generally impose a VAT or GST on ordinary retail sales. Where a specific product or transaction is subject to an applicable tax, duty, excise charge or other compulsory amount, it will be handled in accordance with applicable law and the information provided before or during checkout where relevant.
The final amount payable by the customer, including any applicable delivery charge and other compulsory charge collected by Kenshi Blades, will be displayed before the order is submitted.
Delivery is free for the destinations served by Kenshi Blades unless a different delivery charge is expressly displayed before the order is confirmed.
Kenshi Blades may update prices for future orders at any time. Products already ordered will be charged at the price displayed and accepted when the order was placed, except where there is a clear and obvious pricing or technical error and cancellation is permitted by applicable law.
Pricing information and promotional representations will not knowingly be presented in a false or misleading manner.
4) Order
The customer selects the desired products and confirms the shopping cart.
Before payment, an order summary displays the principal details of the order, including the selected products, quantities, prices and applicable delivery charges.
The customer is responsible for checking the order information and correcting any errors before submitting the order.
Once payment has been successfully submitted and the order has been accepted by Kenshi Blades, an order confirmation will be sent electronically.
Kenshi Blades may refuse or cancel an order where there are reasonable grounds to do so, including suspected fraud, unlawful activity, payment failure, product unavailability, a clear and obvious pricing or technical error, delivery impossibility or another legitimate reason permitted by applicable law.
If an order is cancelled after payment and before the relevant products have been supplied, any amount that must be refunded will be returned without unreasonable delay.
5) Payment
Payment is due when the order is submitted unless another payment arrangement is expressly displayed at checkout.
Accepted payment methods are those displayed at checkout and may include credit or debit cards, digital wallets or other payment services.
Payment transactions are transmitted using secure encrypted connections and are processed by the applicable payment service provider.
Kenshi Blades does not directly store complete payment-card details where those details are handled by the relevant payment provider.
Payment providers may apply their own terms, authentication requirements, fraud-prevention procedures and privacy policies.
6) Delivery
Delivery is free, with no minimum purchase amount, to the destinations we serve: United States, United Kingdom, Canada, Australia, New Zealand. (basket total after discounts).
Products are normally processed within 2 to 3 business days following payment confirmation. Typical delivery times are 4 to 8 business days from dispatch. The estimated total delivery time is 7 to 10 business days.
Delivery times may vary depending on the delivery address, parcel characteristics, order volume, public holidays, severe weather, transport disruption or other circumstances reasonably affecting delivery.
Where a specific delivery period has been represented or agreed, Kenshi Blades will use reasonable efforts to fulfil the order within that period and will inform the customer where a material delay becomes known.
Hong Kong does not impose a general statutory rule requiring every ordinary online retail order to be delivered within 30 days.
Where no specific delivery period has been stated, the products will be supplied within a reasonable period having regard to the circumstances and the information provided when the order was accepted.
Kenshi Blades will not knowingly accept payment where it has no intention to supply the product or no reasonable grounds for believing that the product can be supplied within the represented period or, if no period is represented, within a reasonable period.
Products are delivered to the address supplied at checkout. The customer is responsible for providing an accurate and complete delivery address and reasonable contact information.
If delivery fails because the customer supplied materially incorrect or incomplete delivery information, reasonable reshipping costs may be charged where permitted by applicable law.

7) Receipt and Conformity
The customer is encouraged to inspect the parcel and products promptly after delivery.
If a product is missing, visibly damaged, incorrect or otherwise appears not to comply with the order, the customer should contact contact@kenshi-blades.com as soon as reasonably possible.
We recommend reporting visible transport damage within 48 hours and providing photographs where reasonably available so that the issue can be investigated efficiently.
This 48-hour recommendation is a practical claim-handling measure only. It does not remove, shorten or restrict any statutory right, rejection right or remedy that may otherwise apply.
Under the Hong Kong Sale of Goods Ordinance (Cap. 26), where applicable, a buyer who has not previously examined the goods is entitled to a reasonable opportunity to examine them for the purpose of determining whether they comply with the contract.
8) 14-Day Contractual Right of Return
Kenshi Blades provides customers with a contractual 14-day change-of-mind return period.
The customer may notify Kenshi Blades within 14 days after receiving the order that they wish to return an eligible product without providing a reason.
To request a return, the customer should contact contact@kenshi-blades.com and provide:
name,
order number,
and the item or items concerned.
Following acceptance of the return request, the products should be returned within 14 days in accordance with the return instructions provided by customer service.
For a change-of-mind return, products should be complete, unused, in their original condition and, where reasonably possible, in their original packaging.
The appropriate return address will be provided by customer service. Please contact contact@kenshi-blades.com before sending a return.
The direct cost of a contractual change-of-mind return is borne by the customer unless Kenshi Blades expressly agrees otherwise.
For an eligible change-of-mind return, refunds are normally processed within 10 business days after the returned product has been received and verified, using the same payment method as the original transaction unless another method is expressly agreed.
Hong Kong does not currently provide a general statutory cooling-off period for ordinary online retail purchases. The 14-day return period in this section is a voluntary contractual benefit offered by Kenshi Blades. Its conditions do not restrict any separate statutory right concerning faulty, misdescribed, unsafe or otherwise non-conforming goods.
9) Defective, Misdescribed or Non-Conforming Products
Customers in Hong Kong may benefit from statutory protections under the Sale of Goods Ordinance (Cap. 26) and other applicable Hong Kong legislation.
Description, Quality and Fitness for Purpose
Where the Sale of Goods Ordinance applies, goods sold by description must correspond with their description.
Goods supplied in the course of business may also be subject to statutory implied conditions concerning merchantable quality and reasonable fitness for their ordinary purpose and, where the applicable requirements are satisfied, a particular purpose made known to the seller.
Where goods are sold by sample, applicable requirements concerning correspondence with the sample may also apply.
Merchantable quality is assessed having regard to matters including the description of the goods, their price and other relevant circumstances. Quality may include appearance and finish, freedom from defects, safety and durability.
Inspection and Rejection
A customer who has not previously examined the goods is entitled to a reasonable opportunity to examine them in order to determine whether they comply with the contract.
Where goods fail to satisfy an applicable statutory condition and have not been legally accepted, the customer may in appropriate circumstances reject the goods and seek reimbursement.
A customer wishing to reject goods should clearly notify Kenshi Blades promptly after discovering the relevant problem.
Where goods have been lawfully rejected, the customer is not required to assume a return obligation that applicable law places on the seller. Kenshi Blades will provide appropriate instructions concerning collection, return or other handling.
If the goods have already been legally accepted, the remedies available may differ and can include damages or another remedy available under applicable law.
Kenshi Blades may also offer, depending on the circumstances, repair, replacement, provision of a replacement part, price reduction, refund or another appropriate solution.
Claims may be submitted to contact@kenshi-blades.com with the order number, a description of the issue and, where reasonably available, photographs or videos.
10) Refund Policy
Refunds are normally issued using the same payment method used for the original purchase unless another method is expressly agreed and legally permitted.
For contractual change-of-mind returns, Kenshi Blades may refuse or reduce a refund where the returned product is incomplete, materially used, altered or damaged contrary to the conditions of the voluntary return policy.
This contractual rule does not apply where it would restrict a separate statutory remedy relating to defective, misdescribed, unsafe, incorrectly supplied or otherwise non-conforming goods.
Where a customer is legally entitled to reject goods and obtain a refund, the applicable refund will be processed in accordance with the relevant legal requirements.

11) Product Availability
If a product becomes unavailable after an order has been accepted, the customer will be informed as soon as reasonably possible.
Depending on the circumstances, the customer may be offered the choice to:
wait for the product to become available,
accept an appropriate alternative where expressly agreed,
or cancel the affected product or order and receive a full refund of the relevant amount paid.
Kenshi Blades will not substitute a materially different product without the customer's agreement.
12) Liability
Customers are responsible for using, handling, maintaining and storing products reasonably and in accordance with their intended purpose and any applicable instructions or safety information.
Kenshi Blades is not responsible for damage caused solely by misuse, unauthorised alteration, improper use or failure to follow applicable instructions, to the extent permitted by law.
Kenshi Blades will not be liable for delays or failures caused solely by circumstances genuinely outside its reasonable control to the extent that applicable law permits such limitation.
Limitation of Liability
Any limitation or exclusion of liability in these TCS applies only to the extent permitted by applicable law.
Kenshi Blades does not seek to exclude or restrict liability for death or personal injury caused by negligence where such liability cannot lawfully be excluded.
Nor do these TCS exclude or restrict any statutory condition or liability concerning description, merchantable quality, fitness for purpose or correspondence with sample where such exclusion or restriction is prohibited in a consumer transaction.
Subject to the preceding paragraphs and applicable law, Kenshi Blades is not liable for indirect or consequential commercial losses that were not reasonably foreseeable as a result of a consumer transaction.
Website access may occasionally be interrupted for maintenance, updates, security operations, network failures or circumstances outside reasonable control. Kenshi Blades does not guarantee continuous and uninterrupted availability of the website.
Despite reasonable efforts to maintain accurate content, genuine typographical or technical errors may occasionally occur. A clear and obvious price or description error may be corrected and, where necessary and legally permitted, the affected order may be cancelled with a full refund.
Minor differences in colour or appearance caused solely by screen settings, lighting or photography are not themselves defects where the goods otherwise materially correspond with their description.
Links to independent third-party websites are provided for convenience. Kenshi Blades does not control those websites and is not responsible for their independent content or practices except where applicable law provides otherwise.
Nothing in these TCS limits liability arising from fraud, fraudulent misrepresentation or another liability that applicable law does not permit to be excluded or restricted.
13) Personal Data
Personal data is processed for purposes including order management, payment, delivery, customer service, fraud prevention, legal compliance and other purposes described in our Privacy Policy.
Because the data controller is established in France, relevant processing is subject to the EU General Data Protection Regulation (GDPR) and applicable French data-protection legislation.
Where Hong Kong's Personal Data (Privacy) Ordinance (Cap. 486) applies to relevant collection, holding, processing or use of personal data, the applicable requirements and Data Protection Principles under that Ordinance will also be respected.

14) Consumer Complaints and Dispute Resolution
If a complaint arises, the customer should first contact Kenshi Blades at contact@kenshi-blades.com so that we can investigate and attempt to resolve the matter directly.

The Hong Kong Consumer Council may assist eligible individual consumers with disputes concerning goods or services through conciliation.
The Consumer Council is not a court or law-enforcement agency and does not itself issue binding judgments.
Where the trader concerned is established overseas, the ability of the Consumer Council to pursue conciliation may depend on whether the trader can be contacted and cooperates with the process.
Small Claims Tribunal
Where it has jurisdiction, the Hong Kong Small Claims Tribunal handles certain monetary claims arising from contract or tort where the amount claimed does not exceed HK$75,000.
Whether a particular claim involving an overseas seller falls within the jurisdiction of a Hong Kong court or tribunal depends on the applicable jurisdictional and procedural rules.
Nothing in these TCS prevents a customer from using a competent court, tribunal or other remedy that is legally available to them.
15) Applicable Law and Jurisdiction
Because NOITAKY Matthieu is established in France, these TCS are governed by French law, subject to applicable conflict-of-law rules.
Where the customer is acting as a consumer and the seller directs its commercial activities to the customer's country of habitual residence, a choice of French law will not have the effect of depriving the consumer of protections provided by provisions that cannot be derogated from under the law that would otherwise apply pursuant to applicable conflict-of-law rules.
Accordingly, where applicable, a Hong Kong consumer retains the benefit of mandatory Hong Kong consumer protections that cannot lawfully be excluded by these TCS.
In the event of a dispute, the parties will first attempt to reach an amicable resolution by contacting contact@kenshi-blades.com.
If no amicable solution is reached, jurisdiction will be determined in accordance with the applicable national and international jurisdictional rules.
Nothing in these TCS imposes an exclusive jurisdiction clause where doing so would unlawfully deprive a consumer of access to a competent court or tribunal.
16) Termination – Cancellation – Suspension
By the seller:
Kenshi Blades may cancel an order or suspend or close an account where reasonably justified by circumstances including non-payment, fraud, suspected fraud, unlawful activity, serious abuse, a clear and obvious pricing or technical error, product unavailability, delivery impossibility or material breach of these TCS.
Where an unshipped order is cancelled by Kenshi Blades after payment has been collected, the relevant payment will be refunded unless a lawful reason permits otherwise.
By the customer:
Customers may request cancellation before dispatch. Where the order has not yet entered a stage at which cancellation can no longer reasonably be processed, the order may be cancelled and the affected amount refunded.
After dispatch, the contractual 14-day change-of-mind return policy in Section 8 may apply according to its conditions.
Separately, defective, misdescribed or non-conforming goods remain subject to any statutory rejection or other remedies available under applicable law.
Effects:
Termination or cancellation does not affect rights or obligations that have already arisen.
Provisions concerning intellectual property, liability, data protection, applicable law and dispute resolution continue to apply to the extent relevant after termination.
Nothing in this section affects a mandatory consumer right that cannot lawfully be excluded or restricted.
17) Modifications to the TCS – Notification
Kenshi Blades may update these TCS for future transactions to reflect changes in law, services, payment methods, delivery arrangements or business practices.
The version applicable to an order is the version presented or made available when the order is placed.
Material changes may be communicated through the website, email or another appropriate method.
Changes made after an order has been accepted do not retrospectively alter the contractual terms applicable to that order unless the customer expressly agrees or applicable law requires otherwise.
18) Intellectual Property
Content available on Kenshi Blades, including texts, descriptions, photographs, videos, visual elements, logos, trademarks, graphic design, structure, code and databases, may be protected by copyright, trademark and other intellectual property rights.
Unless permitted by applicable law, reproduction, modification, adaptation, translation, extraction, reuse or distribution of protected content requires prior authorisation from Kenshi Blades or the relevant rights holder.
Customers receive a limited personal and non-commercial right to access and use the website for ordinary browsing and purchasing purposes.
Product photographs, descriptions or other protected content may not be copied and commercially reused on another website or platform without authorisation, except where such use is otherwise permitted by applicable law.
Where a customer voluntarily publishes content such as a review, photograph or comment and grants Kenshi Blades permission to use that content, such use will remain subject to applicable intellectual property, privacy and other legal requirements.

20) Additional Consumer Terms for Hong Kong
Hong Kong market supplement effective: 21/08/2026
This Section 20 applies to customers acting as consumers whose order is directed to the Hong Kong market.
Nothing in these TCS excludes, restricts or modifies a statutory condition, right, remedy, liability or other protection that cannot lawfully be excluded, restricted or modified under applicable law.
If another provision of these TCS conflicts with an applicable mandatory rule, the mandatory rule prevails to the extent of the conflict and the remainder of these TCS continues to apply.
Any request that an issue be reported within 48 hours, that photographs or videos be supplied, that goods be unused or in their original packaging, that a particular return procedure be followed or that the customer bear return costs applies only to the extent permitted by applicable law and does not restrict a separate statutory right concerning defective or non-conforming goods.
20.1) Contractual 14-Day Change-of-Mind Return
Hong Kong does not currently provide a general statutory cooling-off period for ordinary online retail purchases.
The 14-day change-of-mind return right offered in Section 8 is therefore a contractual benefit provided voluntarily by Kenshi Blades.
Eligible customers may notify Kenshi Blades within 14 days after receiving the order and return the relevant products according to the conditions set out in Section 8 and the Returns and Refunds Policy.
This contractual return policy is separate from the rights available where goods are defective, unsafe, misdescribed, incorrectly supplied or otherwise fail to comply with an applicable statutory condition.
20.2) Sale of Goods Ordinance (Cap. 26)
Where the Hong Kong Sale of Goods Ordinance applies, goods sold by description must correspond with their description.
Where goods are supplied in the course of business, applicable implied conditions may require the goods to be of merchantable quality and reasonably fit for their ordinary purpose and, where the legal requirements are satisfied, any particular purpose made known to the seller.
Where goods are sold by sample, the bulk must satisfy the applicable statutory requirements concerning correspondence with the sample.
Merchantable quality is assessed having regard to the description, price and all other relevant circumstances. Relevant aspects of quality may include appearance and finish, freedom from defects, safety and durability.
20.3) Examination, Acceptance and Rejection
A customer who has not previously examined the goods is entitled to a reasonable opportunity to examine them for the purpose of determining whether they comply with the contract.
Under the applicable rules, a customer may be treated as having accepted goods where the customer expressly indicates acceptance, acts in a manner inconsistent with the seller's ownership, or retains the goods for a reasonable period without communicating rejection after having had a reasonable opportunity to examine them.
If goods breach an applicable statutory condition and have not been legally accepted, the customer may in appropriate circumstances reject them and seek a refund.
A customer wishing to reject goods should communicate rejection clearly and promptly to Kenshi Blades at contact@kenshi-blades.com.
Where goods have been delivered and the customer has a lawful basis to reject them, the customer is not necessarily required personally to return them to the seller in order to make the rejection effective. Clear notification of rejection may be sufficient where the statutory requirements are satisfied.
Kenshi Blades will provide appropriate collection, return or other handling instructions after receiving the notification.
After goods have been legally accepted, the customer may have different remedies, including damages or another remedy available under applicable law.
20.4) Control of Exemption Clauses Ordinance (Cap. 71)
Any exclusion or limitation of liability in these TCS is subject to the Control of Exemption Clauses Ordinance where that Ordinance applies.
In a consumer transaction, contractual terms cannot be used to exclude or restrict liability for breach of certain statutory obligations under the Sale of Goods Ordinance concerning title, description, merchantable quality, fitness for purpose and correspondence with sample where such exclusion is prohibited by law.
Other exemption or limitation clauses may also be subject to applicable statutory requirements, including requirements of reasonableness.
Nothing in these TCS excludes liability for death or personal injury resulting from negligence where such exclusion is prohibited.
20.5) Trade Descriptions Ordinance (Cap. 362)
Kenshi Blades will not knowingly use false trade descriptions or prohibited unfair trade practices in connection with goods offered to Hong Kong consumers.
Product descriptions, specifications, prices, availability information, delivery representations, return terms, warranty statements and other material information must not be presented in a false or misleading manner where the applicable provisions of the Trade Descriptions Ordinance apply.
The Ordinance also prohibits specified unfair trade practices, including misleading omissions, aggressive commercial practices, bait advertising, bait-and-switch and wrongly accepting payment.
In particular, Kenshi Blades will not accept payment where, at the time payment is accepted, it intends not to supply the product, intends to supply a materially different product, or has no reasonable grounds for believing that the product can be supplied within the stated period or, where no period is stated, within a reasonable period.
20.6) Delivery
The delivery times communicated on Kenshi Blades, at checkout or in the order confirmation are estimates or agreed periods according to their wording.
Hong Kong does not apply a universal statutory 30-day delivery rule to ordinary online retail purchases.
Where delivery by a specific date has been agreed and that timing is essential to the transaction, failure to deliver as agreed may give rise to rights or remedies depending on the circumstances.
If Kenshi Blades becomes unable to supply an ordered product, the customer will be informed and an appropriate solution will be offered, including a refund where the order is cancelled.
A customer's rights against Kenshi Blades in relation to a lost or undelivered parcel are not conditional on the carrier first compensating Kenshi Blades.
20.7) Product Safety
Where the Consumer Goods Safety Ordinance (Cap. 456) applies to a product supplied in Hong Kong, the applicable statutory safety requirements remain unaffected by these TCS.
Nothing in these TCS permits the supply of consumer goods that fail to comply with an applicable mandatory safety requirement.
Any legally required product safety warning or caution will be provided in the form required by applicable Hong Kong law.
20.8) Personal Data
Where Hong Kong's Personal Data (Privacy) Ordinance (Cap. 486) applies, personal data will be handled in accordance with the applicable statutory requirements and Data Protection Principles.
Privacy requests concerning Hong Kong may be submitted to contact@kenshi-blades.com.
Because NOITAKY Matthieu is established in France, the processing of personal data in the context of that establishment also remains subject to applicable GDPR and French data-protection requirements.
20.9) Complaints and Consumer Council
Customers should first contact Kenshi Blades at contact@kenshi-blades.com and provide sufficient information for the complaint to be investigated.
If a complaint cannot be resolved directly, an eligible individual consumer may contact the Hong Kong Consumer Council.
The Consumer Council handles eligible complaints through conciliation and seeks to assist consumers and traders in reaching mutually acceptable resolutions.
The Consumer Council does not exercise judicial powers and cannot itself impose a binding judgment on either party.
20.10) Courts and Small Claims
Where the Hong Kong Small Claims Tribunal has jurisdiction, it may hear certain monetary claims arising from contract or tort where the amount claimed does not exceed HK$75,000.
The fact that NOITAKY Matthieu is established outside Hong Kong may affect jurisdiction, service and enforcement. Whether a particular dispute can be heard in Hong Kong depends on the applicable procedural and jurisdictional rules.
Nothing in these TCS prevents a customer from bringing a claim before a court or tribunal that has jurisdiction under applicable law.
20.11) Applicable Law for Hong Kong Consumer Contracts
French law is chosen as the governing law of these TCS because NOITAKY Matthieu is established in France.
However, where applicable conflict-of-law rules provide mandatory protection to a Hong Kong consumer because Kenshi Blades directs commercial activities to Hong Kong and the transaction falls within those activities, the choice of French law does not deprive the consumer of protections that cannot be derogated from under the law that would otherwise apply.
Accordingly, the governing-law clause must be read together with all applicable mandatory consumer protections described in this Section 20.
