Terms and Conditions of Sale (TCS)

1) Scope of Application
These General Terms and Conditions of Sale (GTCS) govern the sales made on the website Kenshi Blades, operated by NOITAKY Matthieu, with its registered office located at 17 rue de l'Amazone, 44470 Carquefou, France.
Any order placed on the website implies full acceptance of these GTCS. The customer acknowledges having read them before confirming the order.
The customer confirms having read and accepted these GTCS by ticking the dedicated box before payment and clicking "Order/Pay". This double action constitutes consent and electronic signature. The customer declares having the legal capacity to contract. The version of the GTCS applicable is the one available online on the day of the order. Records (logs, timestamps, emails, invoices) are kept as proof and may be downloaded or printed by the customer.
2) Products
Products offered for sale are described and presented as accurately as possible. Photographs and visuals are non-contractual but faithfully illustrate the products. Kenshi Blades reserves the right to modify the product selection or characteristics at any time without prior notice.
3) Prices
Prices are displayed in the currency applicable to the customer's selected market or country of delivery. Depending on the market, prices may be shown in United States dollars (USD), pounds sterling (GBP), Canadian dollars (CAD), Australian dollars (AUD) or New Zealand dollars (NZD).
All prices include all applicable taxes that are required to be included in the advertised price. For the United Kingdom, Australia and New Zealand, the displayed product price includes the applicable VAT or GST.
For the United States and Canada, applicable sales taxes are calculated and clearly displayed at checkout where required, in accordance with local tax rules. The customer will always be shown the final total price, including all applicable taxes and mandatory charges, before confirming the order.
Delivery is free in the countries served by Kenshi Blades, unless a different delivery charge is expressly displayed before the order is confirmed. No undisclosed tax or compulsory charge will be added after the order has been placed.
Kenshi Blades reserves the right to update prices at any time. However, products will be charged at the price and in the currency displayed when the order is placed, except in the case of a clear and obvious pricing error.
4) Order
The customer selects the products and validates the basket. Before payment, an order summary displays the product details, prices, and delivery costs. The order becomes final once payment is confirmed. Kenshi Blades reserves the right to refuse an order in case of previous disputes or suspected fraud.
5) Payment
Payment is due immediately upon ordering. Accepted payment methods include those displayed on the website (credit/debit card, PayPal, or any other available method). Transactions are secured via HTTPS and processed by a PCI-DSS compliant payment service provider. Kenshi Blades never has access to the customer's banking data.
6) Delivery
Delivery is free, with no minimum purchase amount, to all countries we serve: United States, United Kingdom, Canada, Australia, New Zealand. (basket total after discounts).
Products are usually in stock and shipped within 2 to 3 business days following payment confirmation. Typical delivery times are 4 to 8 business days from dispatch. The estimated total delivery time is 7 to 10 business days.
Delivery times may vary depending on destination, parcel size, or peak seasons. In case of delay, the customer will be informed by email as soon as possible.
If delivery is not made within a reasonable time, the customer may exercise their rights under applicable US consumer protection laws, including cancelling the order and receiving a full refund.
Products are delivered to the address provided during checkout. In case of an incorrect or incomplete address, resulting in failed delivery, reshipping costs will be borne by the customer.
7) Receipt and Conformity
The customer must check the condition of the parcel upon receipt and report any issue (missing or damaged product, etc.) within 48 hours to contact@kenshi-blades.com. A photo of any damaged product is required to facilitate claim processing.
8) Right of Return
The customer has 14 days from receipt of the order to exercise the right of return without providing a reason.
To exercise this right, the customer must send an email to contact@kenshi-blades.com specifying:
name,
order number,
and items concerned.
The return must be made within 14 days after notifying the return request. Products must be unused, in perfect condition, and in their original packaging.
The return address will be provided by our customer service upon request. Please contact us at contact@kenshi-blades.com before returning any item.
Return costs are borne by the customer unless the product is defective or the return is due to an error on our part.
Refunds are issued within 10 business days after the returned product is received and verified, using the same payment method as the original transaction.
9) Defective Products or Order Errors
The customer benefits from legal protections under US law, including:
Federal consumer protection regulations (FTC Act),
Implied warranties under the Uniform Commercial Code (UCC).
Implied Warranty of Merchantability
Kenshi Blades must supply goods that are of satisfactory quality, fit for purpose, and as described. If a product is faulty or not as described, the customer may request repair, replacement, or refund depending on the circumstances.
The customer should report any issue to contact@kenshi-blades.com, including:
order number,
description of the issue,
and, where possible, photos of the product.
Defective Products
The customer may claim compensation or request remedies if a defect renders the product unsafe or unsuitable for normal use. Claims must be made within a reasonable time after discovering the defect.

10) Refund Policy
Refunds are issued using the same payment method as used for purchase. No refund will be issued for incomplete or damaged returned products.

11) Product Availability
In case a product becomes unavailable after the order is placed, the customer will be informed by email and offered the choice to:
wait for restocking,
or receive a full refund.
12) Liability
Kenshi Blades is not liable for damages caused by misuse of the products. Kenshi Blades is not responsible for delays or delivery failures due to force majeure (strikes, weather disruptions, transport issues, etc.).
Limitation of Liability
Within the limits permitted by US law:
Kenshi Blades is not liable for indirect damages (loss of opportunity, profit, data, or reputation) arising from use of the website or products.
Website access may be interrupted for maintenance, updates, or due to force majeure; Kenshi Blades is not responsible for temporary unavailability.
Despite our efforts, content errors (photos, descriptions, prices) may occur. In case of a manifest error, the order may be cancelled with a full refund.
Colours and renderings may vary depending on screens and lighting conditions; such variations are not considered defects.
Links to third-party websites are provided for convenience; Kenshi Blades is not responsible for their content or practices.
Products are intended for non-professional use; any professional use is at the customer's own responsibility.
Customs duties or import taxes for international deliveries may apply and are not charged by Kenshi Blades.
Nothing limits liability in cases of fraud, gross negligence, or personal injury caused by negligence.
13) Personal Data
Personal data is collected for order processing and customer relations. In accordance with applicable US privacy laws, including the California Consumer Privacy Act (CCPA) where applicable, the customer has rights of access, rectification, and deletion.

14) Consumer Dispute Resolution
Customers may use an Alternative Dispute Resolution (ADR) entity approved by the American Arbitration Association (AAA).

15) Applicable Law and Jurisdiction
These GTCS are governed by the laws of the United States. In case of dispute, parties will seek amicable resolution first. Failing that, the federal courts of the United States shall have exclusive jurisdiction.
16) Termination – Cancellation – Suspension
By the seller:
Kenshi Blades may cancel an order or suspend/close an account in case of non-payment, fraud, suspected fraud, abuse (abnormal returns, abusive behaviour), manifest error (price/description), product unavailability, or breach of these GTCS. Customers are informed accordingly, and payments for unshipped orders will be refunded.
By the customer:
Customers may cancel an order before it is shipped (full refund). After shipment, the right of return applies.
Effects:
Termination does not affect prior obligations (payments due, returns). Intellectual Property, Liability, Data Protection, and Applicable Law clauses survive termination.
These provisions do not affect statutory consumer rights under US law.
17) Modifications to the GTCS – Notification
We may update these GTCS at any time. The applicable version is the one available online at the time of the order. Significant changes may be notified via website banner and/or email.
Orders placed before updates remain governed by the previous version.
18) Intellectual Property
All content on Kenshi Blades (texts, descriptions, photos, videos, visuals, logos, trademarks, graphic design, structure, code, databases) is protected by copyright and trademark law. It is the exclusive property of Kenshi Blades and/or its partners.
Any reproduction, modification, adaptation, translation, extraction, reuse, or distribution, in whole or in part, is prohibited without prior written consent.
Customers receive a personal, non-commercial licence to access and use the website solely for browsing and purchasing products.
Using our product photos or descriptions on other websites or platforms without written permission is strictly prohibited.
Customer-generated content (reviews, photos, comments): By publishing content, the customer grants Kenshi Blades a non-exclusive, free, worldwide licence to use, reproduce, and adapt it for promotional purposes, subject to privacy rights and moderation.

20) Additional Mandatory Consumer Terms for the United Kingdom, Australia, Canada and New Zealand
Market-specific supplement effective: 06/08/2026
This Section 20 applies only to customers acting as consumers whose delivery address is in the United Kingdom, Australia, Canada or New Zealand. The provisions relating to customers in the United States remain unchanged. This Section 20 forms an integral part of these GTCS.
Nothing in these GTCS excludes, restricts or modifies any guarantee, right, remedy or liability that cannot lawfully be excluded, restricted or modified under the mandatory consumer laws applicable in the customer's country, province, territory, state or other place of residence. If any provision of these GTCS conflicts with such a mandatory rule, the mandatory rule will prevail to the extent of the conflict, while the remaining provisions will continue to apply.
Any request that an issue be reported within 48 hours, that photographs be supplied, that goods be unused or returned in their original packaging, or that another procedural condition be followed is intended to help us process claims efficiently. It does not remove or reduce any mandatory statutory consumer right. Likewise, any provision concerning return costs, refund timing, incomplete or damaged returns, limitations of liability, dispute resolution, applicable law or jurisdiction applies only to the extent permitted by the mandatory law applicable to the customer.
Before the order is placed, the customer will be given the information required by applicable law, including the seller's identity and contact details, the main characteristics of the products, the total price and applicable currency, taxes and unavoidable charges, delivery charges and arrangements, payment terms, and the applicable cancellation, return and complaint procedures. The customer will have an opportunity to review and correct the order before submitting it. An order confirmation and a copy of, or durable access to, the contractual information will be supplied by email or another durable medium where required by applicable law.
20.1) United Kingdom
For consumers in the United Kingdom, these GTCS are supplemented by the Consumer Rights Act 2015, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, applicable data protection legislation including the UK GDPR and the Data Protection Act 2018 as amended, and any other mandatory United Kingdom consumer law.
Distance-contract cancellation right: Subject to the statutory exceptions, a United Kingdom consumer may cancel an online order without giving a reason within 14 days after the day on which the consumer, or a person nominated by the consumer other than the carrier, takes physical possession of the goods. For an order containing multiple goods delivered separately, the cancellation period runs from receipt of the last item, lot or piece where the applicable rules so provide.
The consumer may exercise this right by sending any clear statement of cancellation to contact@kenshi-blades.com or by using the model cancellation form below. After notifying cancellation, the consumer must return the goods without undue delay and no later than 14 days after communicating the decision to cancel.
We will reimburse all payments received for the cancelled goods, including the cost of the least expensive standard delivery method offered by us, without undue delay and no later than 14 days after we receive the returned goods or, if earlier, after the consumer supplies evidence that the goods have been sent back. We may withhold reimbursement until the goods are received or such evidence is supplied. Additional delivery costs resulting from the customer's choice of a delivery method more expensive than our standard method are not refundable unless required by law.
The consumer bears the direct cost of returning goods following a change-of-mind cancellation where this was disclosed before purchase. We bear return costs where the goods are faulty, not as described, sent in error, or where applicable law otherwise requires us to do so. The consumer may inspect and handle the goods only as reasonably necessary to establish their nature, characteristics and functioning. A lawful deduction may be made for diminished value caused by handling beyond what would reasonably be permitted in a shop.
The statutory cancellation right may not apply to goods covered by a legal exception, including, where applicable, personalised or made-to-order goods, sealed goods not suitable for return for health-protection or hygiene reasons once unsealed, goods liable to deteriorate or expire rapidly, or goods inseparably mixed with other items after delivery. Any exception will be identified before purchase where required.

Faulty or non-conforming goods: Goods must be of satisfactory quality, fit for any particular purpose made known to us, and match their description. Where the Consumer Rights Act 2015 applies, the consumer may have a short-term right to reject qualifying faulty goods within 30 days and may also be entitled, depending on the circumstances and the statutory sequence of remedies, to repair, replacement, a price reduction or a final right to reject. These rights are separate from and additional to the contractual 14-day return policy.
Delivery: Unless another delivery period has been agreed, goods will be delivered without undue delay and normally no later than 30 days after the contract is entered into. Any statutory right to require delivery within an additional appropriate period, cancel for qualifying late delivery, and obtain reimbursement remains unaffected.
Complaints and privacy: Consumers may obtain independent consumer information from Citizens Advice. Privacy complaints may be made to us first at contact@kenshi-blades.com and, where applicable, to the Information Commissioner's Office. Nothing in the existing applicable-law or jurisdiction clause prevents a United Kingdom consumer from relying on mandatory United Kingdom law or bringing a claim before a court that has jurisdiction under mandatory rules.
20.2) Australia
For consumers in Australia, our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law contained in Schedule 2 to the Competition and Consumer Act 2010. Any contractual warranty or return policy is additional to, and does not replace, these guarantees.
Goods supplied to an Australian consumer must, where the Australian Consumer Law applies, be of acceptable quality, be fit for any disclosed purpose, match their description and any sample or demonstration model, and satisfy the other applicable consumer guarantees.
If goods have a major failure, the consumer may be entitled to reject the goods and choose a refund or replacement, or keep the goods and seek compensation for the reduction in value. If the failure is not major, we may be entitled to provide a repair within a reasonable time. If we fail to do so, the consumer may have further statutory remedies. The consumer may also be entitled to compensation for reasonably foreseeable loss or damage caused by a failure to comply with a consumer guarantee.
Any statement in these GTCS that a refund will not be provided, that a claim must be made within a particular contractual period, or that goods must be unused, complete or in their original packaging does not apply where it would conflict with the Australian Consumer Law. Reasonable return or postage costs will be reimbursed where required by that law. For bulky goods or goods that cannot reasonably be returned without significant cost, collection will be arranged where legally required.
Australian law does not generally require a refund solely because a consumer changes their mind. However, the 14-day contractual return right set out in Section 8 continues to apply according to its terms, in addition to all non-excludable Australian Consumer Law rights.
Prices, the applicable currency, compulsory charges, taxes and delivery costs will be clearly disclosed before the order is confirmed. Statements about availability, dispatch and delivery will not exclude any rights arising from misleading representations or a failure to supply within an agreed or reasonable time.
Where the Privacy Act 1988 and the Australian Privacy Principles apply to our handling of personal information, personal information will be handled in accordance with those requirements and our Privacy Policy. Consumers may complain to us at contact@kenshi-blades.com and, where applicable, to the Office of the Australian Information Commissioner.
Australian consumers may obtain consumer information from the Australian Competition and Consumer Commission and may contact the relevant state or territory consumer protection agency for individual assistance. Nothing in the existing applicable-law, jurisdiction, liability or dispute-resolution clauses excludes the operation of mandatory Australian law or any right to use a competent Australian court or tribunal where that right cannot lawfully be excluded.
20.3) Canada
For consumers in Canada, these GTCS are subject to the mandatory consumer protection laws of the consumer's province or territory, together with applicable federal legislation. Consumer rights and online-contract requirements vary between provinces and territories and cannot be waived where the applicable law makes them mandatory.
Before an order is submitted, Canadian consumers will be shown the seller's contact information, a detailed description of the goods, the total price, the applicable currency, taxes and additional charges, delivery arrangements, the expected supply or delivery information, and the applicable cancellation, return, exchange and refund terms, to the extent required by the applicable provincial or territorial law. A written or electronic copy of the internet agreement or order confirmation will be supplied within the period required by the applicable law.
A Canadian consumer may have statutory cancellation or refund rights where required information was not disclosed, where a compliant copy of the internet agreement was not provided, where goods were not supplied within the agreed or legally permitted period, or in other circumstances specified by the law of the consumer's province or territory. Any such rights apply in addition to the contractual 14-day return policy in Section 8.
Any contractual requirement to notify us within 48 hours, provide photographs, retain original packaging, pay return costs, or comply with another return condition does not limit a non-waivable right or remedy under applicable Canadian law. Similarly, the provisions concerning liability, exclusive United States jurisdiction and dispute resolution do not deprive a Canadian consumer of the protection of mandatory federal, provincial or territorial law or access to a competent court or tribunal where such protection or access cannot lawfully be waived.
Personal information relating to Canadian consumers will be handled, where applicable, in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and any applicable substantially similar or additional provincial privacy legislation. Privacy requests or complaints may be sent to contact@kenshi-blades.com. Consumers may also consult the Office of the Privacy Commissioner of Canada or the applicable provincial privacy regulator.
Canadian consumers may identify the competent consumer protection authority through the Government of Canada's directory of federal, provincial and territorial consumer affairs offices.
20.4) New Zealand
For consumers in New Zealand, these GTCS are supplemented by the Consumer Guarantees Act 1993, the Fair Trading Act 1986, the Privacy Act 2020 where applicable, and any other mandatory New Zealand consumer law. Nothing in these GTCS contracts out of the Consumer Guarantees Act in relation to a consumer transaction where contracting out is prohibited.
Goods supplied to a New Zealand consumer must be of acceptable quality, be fit for their normal purpose and any particular purpose made known to us, match their description, and satisfy the other guarantees imposed by the Consumer Guarantees Act. Products must also be supplied within the agreed time or, if no time has been agreed, within a reasonable time.
If goods fail to comply with a statutory guarantee, the consumer may be entitled, depending on the nature and seriousness of the failure, to require a remedy, obtain a repair or replacement, reject the goods and obtain a refund, or recover compensation for reasonably foreseeable loss. A serious failure may permit the consumer to reject the goods rather than first accepting a repair. These rights apply regardless of any manufacturer or contractual warranty.
Any 48-hour reporting request, photo request, packaging condition, contractual deadline, return-cost provision or exclusion of refunds in these GTCS does not limit the remedies available under the Consumer Guarantees Act or the Fair Trading Act. Reasonable return or collection costs will be handled as required by New Zealand law.
New Zealand law does not generally require a refund solely because a consumer changes their mind. However, the contractual 14-day return right in Section 8 remains available according to its terms and is additional to all statutory rights.
Where the Privacy Act 2020 applies, personal information will be collected, used, stored, disclosed and transferred in accordance with that Act and our Privacy Policy. Privacy requests or complaints may be sent to contact@kenshi-blades.com and, where appropriate, to the Office of the Privacy Commissioner.
New Zealand consumers may obtain information from Consumer Protection New Zealand and may use the Disputes Tribunal where it has jurisdiction. Nothing in the existing applicable-law, jurisdiction, liability or dispute-resolution clauses excludes mandatory New Zealand law or prevents a consumer from using a competent New Zealand court or tribunal where that right cannot lawfully be excluded.
