NOITAKY Matthieu is established in France. Accordingly, applicable French and European data-protection and electronic-communications requirements may apply to certain processing activities carried out in the context of that establishment.
Where the Singapore Personal Data Protection Act 2012 (“PDPA”) applies to personal data collected, used or disclosed through cookies or similar technologies, New kenshi also handles that personal data in accordance with the applicable Singapore requirements.
2) What Are Cookies and Similar Technologies?
Cookies are small text files that may be stored on a computer, smartphone, tablet or other device when a website is visited.
Cookies can be used to remember information about a browser or device and to provide website functionality.

French and European Requirements
Where French or European rules requiring prior consent apply, non-essential technologies such as advertising, personalisation or non-exempt analytics technologies are not activated before valid consent has been obtained.
For consistency and privacy protection, New kenshi may apply this prior-consent approach to optional technologies more broadly across the website, even where another lawful approach may be available under Singapore law.
Users may therefore be offered controls allowing them to:
- Accept optional technologies;
- Reject optional technologies;
- Select individual categories;
- Modify their choices later.
Where prior consent is required, simply closing the cookie banner, remaining inactive or continuing to browse is not treated as affirmative consent.
Refusing optional technologies does not prevent access to the main shopping functions of the website, although some optional features may be unavailable.

- Customer-service, review, email or other Shopify applications: where such services are installed and enabled on the store.

6) Google Analytics, Google Ads and Consent Mode

New kenshi may use Google Consent Mode to communicate consent choices or privacy settings to Google tags.
Google Consent Mode does not itself constitute or replace legally required consent. It is a technical mechanism used to adapt Google tag behaviour according to the choices communicated through the consent-management system.
Google technologies are configured and used in accordance with the privacy choices presented to the user and the legal requirements applicable to the relevant processing.

7) Cookie Retention and Consent Records
Cookies and similar technologies are retained only for as long as reasonably necessary for their stated purposes.
Session cookies normally expire at the end of a browser session.
Persistent cookies may remain on the device until:
- Their configured expiration date;
- The user deletes them;
- The relevant service changes them; or
- They are otherwise removed by the browser or device.
The duration of individual technologies depends on their function, provider and configuration.

Singapore
Where personal data subject to the Singapore PDPA is transferred outside Singapore and the Transfer Limitation Obligation applies, reasonable steps and appropriate arrangements will be used to ensure that the transferred personal data receives a standard of protection comparable to that required under the PDPA, unless an applicable exception permits otherwise.
European Union
Where personal data subject to the GDPR is transferred outside the European Economic Area, transfers are handled in accordance with the applicable requirements of Chapter V of the GDPR.

10) Additional Cookie and Privacy Rules — Singapore
Nothing in this Cookie Policy excludes or restricts a privacy right or data-protection obligation that cannot lawfully be excluded where the Singapore PDPA applies.
10.1) Cookies and Personal Data
The Singapore PDPA applies to the collection, use and disclosure of personal data through cookies and similar technologies where the information concerned constitutes personal data.
Not every cookie necessarily contains or collects personal data.
10.2) Cookies That Do Not Collect Personal Data
Under guidance issued by Singapore's Personal Data Protection Commission, consent under the PDPA is not required merely for the use of cookies that do not collect personal data.
10.3) User-Requested Functions
Some online activities requested by the user depend on cookies or similar technologies.
This may include:
- Maintaining a shopping cart;
- Completing checkout;
- Remembering information entered into a form;
- Authentication;
- Security and fraud prevention;
- Providing another function specifically requested by the user.
Where the applicable PDPA conditions are satisfied, separate express cookie consent may not be necessary for personal data processing that is reasonably required for such requested activities.

The way an individual configures their browser or device may, in appropriate circumstances, indicate a choice concerning the use of particular cookies.
Such settings are considered together with the nature of the technology, the information provided to the user and the applicable legal requirements.
10.7) Analytics and Advertising
Analytics, advertising and personalisation technologies that process personal data are used only in accordance with applicable notification, consent and other PDPA requirements.
Where stricter French or European prior-consent rules apply, those technologies remain disabled until the necessary consent has been obtained.
10.8) Withdrawal of Consent
Where personal-data processing relies on consent under the Singapore PDPA, the individual may withdraw that consent by giving reasonable notice.
New kenshi will explain any applicable consequences where required and will cease the relevant collection, use or disclosure unless continued processing is permitted or required by law.
10.9) Protection and Retention
Personal data collected through cookies or similar technologies is subject to appropriate security measures and is not retained longer than reasonably necessary for the relevant purpose and applicable legal or business requirements.
10.10) Website Operator Established in France
NOITAKY Matthieu is established in France.
Accordingly, French and European cookie and data-protection requirements may continue to apply to processing carried out in the context of that establishment.
Where Singapore PDPA requirements also apply to a Singapore visitor or processing activity, this Policy is intended to accommodate both sets of applicable requirements without reducing any mandatory protection.
11) Policy Updates
New kenshi may update this Cookie Policy to reflect changes in website functionality, technologies, providers, processing practices or applicable legal requirements.
The date of the latest update appears at the top of this page.
Where a material change requires a new notification, consent choice or other action under applicable law, the appropriate measure will be implemented.
