Warranty Policy

Purpose

This page explains the statutory consumer rights and the commercial warranty applicable to eligible products sold through New kenshi, together with the conditions and procedure for making a claim.

The New kenshi commercial warranty is an additional contractual benefit. It does not replace, restrict or remove any mandatory statutory right or remedy that may apply independently under Singapore law.

1) Statutory Consumer Rights in Singapore

Where Singapore consumer law applies, customers may have statutory rights under legislation including the Consumer Protection (Fair Trading) Act 2003 (“CPFTA”), including its provisions commonly referred to as the Lemon Law, the Sale of Goods Act 1979 and other applicable legislation.

Quality, description and fitness for purpose

Where the applicable requirements of the Sale of Goods Act apply, goods sold in the course of a business are subject to implied terms concerning their conformity with the contract.

Depending on the circumstances, goods must in particular:

  • Correspond with their description;
  • Be of satisfactory quality;
  • Be reasonably fit for their normal purposes;
  • Be reasonably fit for a particular purpose made known to the seller where the relevant legal conditions are met;
  • Meet applicable requirements relating to appearance, finish, freedom from defects, safety and durability.

What constitutes satisfactory quality depends on factors including the description of the goods, the price and other relevant circumstances.

Singapore Lemon Law

Where the Lemon Law provisions of the CPFTA apply and goods did not conform to the applicable contract at the time of delivery, the consumer may have statutory remedies against the seller.

Six-month presumption

If a lack of conformity is established within six months after delivery, it is generally treated as having existed at the time of delivery unless:

  • It is established that the goods did conform at the time of delivery; or
  • Such a presumption would be incompatible with the nature of the goods or the nature of the lack of conformity.

Repair or replacement

Where the statutory Lemon Law remedy applies, the consumer may require the seller to repair or replace the non-conforming goods.

The repair or replacement must be carried out within a reasonable time and without causing significant inconvenience to the consumer.

The seller bears the necessary costs of the statutory repair or replacement, including applicable labour, materials and postage costs.

A particular remedy may not be required where it is impossible or disproportionate in the circumstances under the applicable legislation.

Price reduction or rescission

In circumstances provided by law, the consumer may be entitled to an appropriate reduction in price or to rescind the contract in respect of the affected goods.

This may apply, for example, where repair or replacement is impossible or disproportionate, or where the seller fails to provide an appropriate repair or replacement within a reasonable time and without significant inconvenience.

Any refund, price adjustment or deduction following rescission will be handled in accordance with the applicable statutory rules and the circumstances of the particular claim.

2) New kenshi Commercial Warranty (Lifetime warranty)

In addition to any statutory consumer rights that may apply, New kenshi provides a commercial warranty lasting Lifetime warranty for eligible products purchased through New kenshi.

Unless different product-specific warranty terms are clearly stated, the commercial warranty begins on the date the product is delivered to the customer.

What is covered

Subject to the conditions of this Policy, the commercial warranty may cover:

  • Manufacturing defects;
  • Material defects attributable to production;
  • Assembly or structural defects originating during manufacture;
  • Abnormal failure during normal and intended use caused by a covered manufacturing defect;
  • Other defects expressly stated to be covered by the warranty applicable to the relevant product.

What is not covered

Unless the issue is independently covered by a mandatory statutory right, the commercial warranty does not normally cover:

  • Normal wear and tear;
  • Damage caused by misuse, abuse or use contrary to the product's intended purpose;
  • Accidental or external damage occurring after delivery and unrelated to a manufacturing defect;
  • Improper installation, storage, cleaning or maintenance;
  • Damage resulting from failure to follow clear product instructions or safety warnings;
  • Unauthorised modifications or repairs where they caused or materially contributed to the problem;
  • Damage caused by environmental conditions for which the product was not designed;
  • Products not purchased through New kenshi, unless expressly stated otherwise.

An exclusion applies only to the extent that the excluded circumstance caused or materially contributed to the relevant issue.

Nothing in these exclusions limits a mandatory statutory remedy where such a remedy applies independently.

Duration

The commercial warranty lasts Lifetime warranty from the applicable commencement date stated above, unless a different or more favourable period is expressly stated for a specific product.

Repair or replacement under the commercial warranty does not automatically restart or extend the original commercial warranty period unless:

  • The product-specific warranty expressly provides otherwise;
  • New kenshi expressly agrees otherwise; or
  • Applicable law requires otherwise.

3) Eligibility Conditions

To make a claim under the New kenshi commercial warranty, the following conditions normally apply:

  • The product was purchased through New kenshi;
  • The claim is made within the applicable Lifetime warranty period;
  • The product was used for its intended purpose and in accordance with applicable instructions;
  • The customer can provide reasonable evidence of purchase, such as an order number, invoice, payment record or other suitable evidence;
  • The issue falls within the scope of the commercial warranty;
  • Information reasonably necessary to assess the claim is provided.

Where reasonably available and useful for diagnosis, the customer may be asked to provide photographs or videos showing the product and the reported issue.

A particular administrative requirement under this commercial warranty will not be applied where doing so would unlawfully restrict a mandatory statutory consumer right.

4) Claim Procedure

  1. Contact contact@kenshiblades.com with the subject line: “Warranty – order number”.
  2. Include, where available:
    • Your order number;
    • The purchase or delivery date;
    • A detailed description of the issue;
    • The date or approximate period when the issue first appeared.
  3. Where reasonably available and useful for assessment, attach:
    • Photographs or videos of the complete product;
    • Close-up photographs or videos showing the issue.

After receiving the claim, we will review the information and provide appropriate instructions.

Depending on the circumstances, these instructions may include further diagnosis, provision of a replacement part, repair, replacement, return or another appropriate remedy.

This prior-contact procedure is intended to prevent returns from being sent to the wrong location. It does not remove or restrict a mandatory statutory remedy.

5) Remedies and Solutions

Depending on the basis of the claim, the nature of the issue and applicable law, available solutions may include:

  1. Repair of the product;
  2. Provision of an appropriate replacement part;
  3. Replacement with an identical product;
  4. Replacement with an equivalent product where appropriate and agreed;
  5. An appropriate reduction in price;
  6. A partial or full refund where applicable;
  7. Another remedy required by applicable consumer law.

Return and Transport Costs

If a claim is validly covered by the New kenshi commercial warranty, New kenshi will bear the reasonable return and reshipping costs covered by that warranty in accordance with the instructions provided to the customer.

Where Singapore statutory law requires the seller to bear necessary costs of repair or replacement, those costs will not be charged to the consumer.

If the customer incurs an authorised expense that New kenshi is required to reimburse, proof of payment may be sent to contact@kenshiblades.com together with the order number and claim details.

A product returned to an incorrect or unauthorised address may experience processing delays. This does not affect a mandatory statutory right that cannot lawfully be made subject to prior authorisation.

6) Product Damaged or Non-Conforming Upon Delivery

If a product is delivered damaged, incomplete, incorrect or otherwise non-conforming, please contact contact@kenshiblades.com as soon as reasonably possible.

Where available, photographs or videos of the product and packaging may help us assess the issue and investigate any transport damage.

We may recommend that visible transport damage be reported within 48 hours so that a carrier investigation can begin promptly.

Depending on the applicable rights and circumstances, an appropriate remedy may include repair, replacement, price reduction, rescission, refund or another solution required by law.

The correct return address will be provided by customer service and is not necessarily the registered office of NOITAKY Matthieu.

7) Territorial Scope

The New kenshi commercial warranty applies to eligible products delivered to United States, United Kingdom, Canada, Australia, New Zealand..

For customers in Singapore, any mandatory Singapore consumer rights that apply to the transaction operate independently of the commercial warranty.

Because NOITAKY Matthieu is established in France, the existence and scope of particular statutory remedies may depend on the law applicable to the contract, conflict-of-laws rules, jurisdictional requirements and the circumstances of the transaction.

Nothing in this Policy is intended to deprive a consumer of a mandatory protection that applies to the transaction and cannot lawfully be excluded.

Unless otherwise expressly stated for a particular product, NOITAKY Matthieu is the provider of the New kenshi commercial warranty described in this Policy.

9) Complaints and Dispute Resolution

If a warranty or product-conformity complaint cannot be resolved directly, the customer may consider the consumer assistance, mediation or legal remedies available under the law applicable to the dispute.

Consumers Association of Singapore (CASE)

Where its services and eligibility requirements apply, consumers in Singapore may approach the Consumers Association of Singapore (CASE) for assistance with consumer disputes, including negotiation or mediation with suppliers.

Consumers Association of Singapore (CASE)

CASE is a consumer organisation that assists consumers with eligible consumer complaints and disputes in Singapore.

Competition and Consumer Commission of Singapore (CCCS)

The Competition and Consumer Commission of Singapore (CCCS) administers and enforces the Consumer Protection (Fair Trading) Act.

CCCS does not generally obtain individual compensation or redress for consumers in private disputes. Individual consumers are generally directed to the appropriate consumer dispute channels, including CASE where applicable.

Small Claims Tribunals

Eligible disputes concerning contracts for the sale of goods or certain claims under the Consumer Protection (Fair Trading) Act may fall within the jurisdiction of the Singapore Small Claims Tribunals where all applicable monetary, time, territorial, service and jurisdictional requirements are satisfied.

Because NOITAKY Matthieu is established in France, the availability of the Singapore Small Claims Tribunals for a particular dispute may depend on whether the applicable jurisdiction and service requirements can be satisfied.

Nothing in this section prevents either party from using another competent court, tribunal or dispute-resolution mechanism where available under applicable law.

10) Additional Mandatory Consumer Rights — Singapore

10.1) Sale of Goods Act

Where the Sale of Goods Act applies to a consumer transaction, statutory implied terms may require goods to correspond with their description and, where applicable, be of satisfactory quality and reasonably fit for purpose.

Satisfactory quality may take into account matters such as:

  • Fitness for normal purposes;
  • Appearance and finish;
  • Freedom from minor defects;
  • Safety;
  • Durability.

10.2) These consumer protections cannot simply be excluded

Where the relevant Singapore legislation applies to a person dealing as a consumer, contractual wording cannot exclude or restrict the statutory obligations relating to conformity with description or sample, satisfactory quality or fitness for purpose to the extent prohibited by the Unfair Contract Terms Act 1977.

10.3) Lemon Law remedies

Where Part 3 of the Consumer Protection (Fair Trading) Act applies to non-conforming goods, the consumer may require repair or replacement in accordance with the statutory conditions.

The repair or replacement must be completed within a reasonable time and without significant inconvenience, and the seller bears the necessary statutory costs.

10.4) Six-month evidential presumption

Where a lack of conformity is established within six months after delivery, the statutory rules generally presume that the goods did not conform at the time of delivery, unless the seller establishes otherwise or the presumption is incompatible with the nature of the goods or defect.

This six-month rule concerns the burden of proof. It does not mean that every statutory right automatically expires six months after delivery.

10.5) Claims after six months

A consumer may still have legal rights after the first six months where the relevant requirements are met.

However, after the six-month presumption no longer assists the consumer, the consumer may need to establish that the relevant non-conformity existed at the time of delivery.

10.6) Price reduction or rescission

Where the statutory requirements are satisfied, a consumer may seek an appropriate reduction in the amount paid or rescission of the contract if the applicable repair or replacement remedies are unavailable, impossible, disproportionate or are not provided within a reasonable time and without significant inconvenience.

10.7) Change of mind is different from a defective-product claim

The Singapore Lemon Law does not, by itself, create a general right to return a product simply because the customer has changed their mind.

Any separate change-of-mind return right offered by New kenshi is governed by the applicable Returns and Refunds Policy, without affecting statutory rights concerning defective or non-conforming goods.

10.8) Commercial warranty remains additional

The Lifetime warranty commercial warranty is separate from statutory rights.

A customer does not lose an otherwise applicable statutory remedy merely because:

  • The commercial warranty has expired;
  • The relevant defect is excluded from the commercial warranty but is independently covered by mandatory law; or
  • The customer chooses to rely on a statutory remedy instead of the commercial warranty.

10.9) Seller established in France

NOITAKY Matthieu is established in France.

Any choice of French law or contractual provision used elsewhere on New kenshi does not exclude a mandatory consumer protection that applies to a Singapore customer where that protection cannot lawfully be excluded under the rules applicable to the transaction.
