Returns and Refunds Policy

1) Introduction
This Returns and Refunds Policy applies to all orders placed on New kenshi and delivered to United States, United Kingdom, Canada, Australia, New Zealand..
Our goal is to provide a simple, transparent and reliable shopping experience. Consumers benefit from the mandatory rights provided by Irish and applicable European Union consumer law, including the statutory cancellation right for eligible distance contracts and remedies where goods are faulty, damaged, unsafe, incorrectly supplied or otherwise do not conform to the sales contract.
Any additional return or refund benefit expressly offered by New kenshi applies in addition to, and does not replace or restrict, mandatory statutory consumer rights.
2) Statutory Right to Cancel — 14-Day Cooling-Off Period
For most eligible goods purchased online, an Irish consumer has the right to cancel the distance contract without giving any reason within 14 days.
For a normal order containing goods, the cancellation period generally starts on the day the consumer, or a person nominated by the consumer other than the carrier, takes physical possession of the goods.
Where multiple goods forming one order are delivered separately, or where goods consist of multiple lots or pieces delivered separately, the applicable starting date is determined in accordance with the Consumer Rights Act 2022.
To exercise the right to cancel, please inform New kenshi before the cancellation period expires by sending a clear statement to contact@kenshiblades.com. You may use the model cancellation form in Section 11, but use of the form is not compulsory.
After notifying us of cancellation, the goods must be returned or handed over without undue delay and no later than 14 days after the day on which you informed us of your decision to cancel.
You are responsible for the direct cost of returning goods following a statutory change-of-mind cancellation where you were informed before purchase that you would bear that cost, unless New kenshi has expressly agreed to bear it.
You may inspect and handle the goods only to the extent reasonably necessary to establish their nature, characteristics and functioning. You may be responsible for diminished value resulting from handling beyond that level where applicable law permits.
The 14-day cooling-off period is a statutory right for eligible online distance contracts in Ireland. It is separate from the rights that apply where goods are faulty, damaged, unsafe, incorrectly supplied or otherwise do not conform to the sales contract.
3) Exceptions to the Statutory Cancellation Right
Subject to the Consumer Rights Act 2022 and other applicable mandatory law, the statutory change-of-mind cancellation right may not apply to certain goods, including:
- Goods made to the consumer's specifications or clearly personalised;
- Sealed goods that are not suitable for return for health-protection or hygiene reasons and that have been unsealed after delivery;
- Goods that are liable to deteriorate or expire rapidly;
- Goods which, after delivery, are according to their nature inseparably mixed with other items;
- Other goods or contracts falling within a statutory exception to the cancellation right.
These exceptions concern the change-of-mind cancellation right only. They do not remove statutory remedies where goods are faulty, damaged, unsafe, incorrectly supplied or otherwise fail to conform to the sales contract.
4) Return Procedure
Please send a return or cancellation request to contact@kenshiblades.com including:
- Your order number;
- The product or products concerned;
- For a statutory change-of-mind cancellation, a clear statement that you wish to cancel the contract;
- For damaged, faulty or incorrect products, a description of the issue and photographs or videos where reasonably available.
You will receive a confirmation email with appropriate return instructions and the correct return address for the product concerned.
Please do not return a product to the registered business address or to an address shown on the parcel unless that address has been confirmed by our customer service team as the appropriate return address.
Pack the product securely to avoid damage during transport and retain reasonable evidence of dispatch until the return and refund have been completed.
Nothing in this procedure makes the exercise of a mandatory statutory consumer right subject to an unlawful or disproportionately burdensome condition.
5) Refund Timeframes and Conditions
Where an Irish consumer validly exercises the statutory right to cancel an eligible online distance contract, New kenshi will reimburse all payments required by law, including the cost of the least expensive standard delivery method offered for the original order.
If the consumer expressly chose a delivery method costing more than the least expensive standard delivery option offered by New kenshi, the additional delivery cost is not required to be refunded.
The statutory reimbursement will be made without undue delay and no later than 14 days after the day on which New kenshi is informed of the consumer's decision to cancel.
For a sales contract, unless New kenshi has offered to collect the goods, reimbursement may be withheld until:
- We have received the goods back; or
- The consumer provides evidence that the goods have been sent back, whichever occurs first.
Refunds will be made using the same payment method used for the original transaction unless the consumer expressly agrees otherwise and does not incur any fee as a result.
Where permitted by law, a deduction may be made for diminished value caused by handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.
Where a refund relates instead to faulty or non-conforming goods, the refund will be processed according to the applicable remedies and reimbursement rules of the Consumer Rights Act 2022.
6) Faulty, Damaged, Unsafe or Incorrect Goods
If goods arrive damaged, defective, unsafe, incomplete, incorrectly supplied, materially different from their description or otherwise fail to conform to the sales contract, please contact contact@kenshiblades.com as soon as reasonably possible.
We recommend reporting visible transport damage promptly so that the issue can be documented and investigated efficiently. Any requested reporting period is administrative only and does not shorten or replace a statutory legal claim period.
Please provide, where reasonably available:
- Your order number;
- A description of the issue;
- Photographs or videos showing the issue and packaging;
- Any other information reasonably necessary to assess the claim.
Where the goods fail to conform to the sales contract, Irish consumers have remedies under the Consumer Rights Act 2022.
Fault identified within the first 30 days
Subject to the statutory requirements, where a lack of conformity becomes apparent during the applicable 30-day period, the consumer may exercise the short-term right to terminate the sales contract and obtain a refund.
The consumer may choose repair or replacement instead of exercising the short-term right to terminate, subject to the statutory rules.
Fault identified after the first 30 days
After the short-term termination period, a consumer with a valid lack-of-conformity claim may generally choose between repair and replacement, unless the chosen remedy is impossible or would impose disproportionate costs compared with the alternative remedy.
Repair or replacement must be carried out free of charge, within a reasonable time and without significant inconvenience to the consumer.
Depending on the circumstances, a consumer may be entitled to a proportionate reduction in price or to terminate the sales contract where repair or replacement is unavailable, unsuccessful, not carried out correctly or within a reasonable time, causes significant inconvenience, or where the lack of conformity is sufficiently serious.
Where the final right to terminate applies, it may not be available where the lack of conformity is minor, as provided by applicable law.
Reasonable return, postage, labour and material costs associated with a statutory repair or replacement will be borne by New kenshi where required by law.
7) Delayed or Lost Parcels
Goods will be delivered within the period agreed with the consumer.
Unless another delivery period has been agreed, goods must be delivered without undue delay and, in any event, no later than 30 days after the sales contract is concluded.
If goods are not delivered within the agreed period or applicable statutory period, the consumer may normally call on New kenshi to make delivery within an additional period appropriate to the circumstances.
If delivery is still not completed within that additional period, the consumer may be entitled to terminate the sales contract and obtain reimbursement.
An additional delivery period may not be required in circumstances provided by law, including where New kenshi has refused to deliver or where delivery by a particular date was essential having regard to the circumstances or information communicated before the contract was concluded.
If a parcel appears lost or has not arrived within the applicable delivery period, please contact contact@kenshiblades.com. We will investigate the shipment with the carrier.
Where the parcel is confirmed lost or the consumer is otherwise legally entitled to a remedy, the appropriate solution may include:
- Cancellation of the affected order;
- A replacement shipment at no additional cost; or
- A full refund of the affected amounts paid.
The consumer's rights against New kenshi are not dependent on the carrier first compensating New kenshi.
8) Return Contact Address
Returns are handled through our customer service team.
The appropriate return address will be communicated by email after the return or claim request has been reviewed and may depend on the product, supplier, warehouse and logistics arrangements concerned.

This requirement is intended to facilitate the return process and does not remove or restrict a consumer's statutory cancellation right or remedies for non-conforming goods.
9) Complaints and Dispute Resolution
If a complaint cannot be resolved directly with New kenshi, Irish consumers may use consumer-information, alternative dispute-resolution or court procedures available under applicable Irish and European Union law.

Because NOITAKY Matthieu is established in France, an Irish consumer who has first attempted to resolve a complaint directly with New kenshi may be able to request assistance from ECC Ireland regarding an eligible cross-border consumer dispute.
Where the applicable conditions are met, the European Small Claims Procedure may also be available for qualifying cross-border civil or commercial claims of up to €5,000.
Nothing in this policy prevents a consumer from bringing a claim before a court that has jurisdiction under applicable law.

11) Additional Mandatory Consumer Rights — Ireland
Nothing in this Returns and Refunds Policy excludes, restricts or modifies any statutory cancellation right, conformity requirement, remedy, liability or other consumer protection that cannot lawfully be excluded, restricted or modified under Irish or applicable European Union law.
11.1) Statutory 14-Day Online Cancellation Right
For eligible distance contracts concluded online, Irish consumers normally have 14 days to cancel without giving a reason.
For goods, the cancellation period generally begins when the consumer, or a person nominated by the consumer other than the carrier, acquires physical possession of the goods, subject to the specific rules applicable to multiple goods, lots and recurring deliveries.
The consumer must communicate the decision to cancel before the applicable cancellation period expires.
After cancellation, the goods must normally be returned no later than 14 days after the consumer informs New kenshi of the cancellation.
11.2) Refund Following Statutory Cancellation
Following a valid statutory cancellation, New kenshi will refund all payments required by law, including the cost of the least expensive standard delivery option originally offered.
Any supplementary cost resulting from the consumer's choice of a more expensive delivery method does not have to be reimbursed.
The reimbursement must be made without undue delay and no later than 14 days after New kenshi is informed of the decision to cancel.
For goods, unless New kenshi has offered to collect them, we may withhold reimbursement until the goods are returned or the consumer supplies evidence that they have been sent back, whichever occurs first.
11.3) Return Costs and Handling
The consumer bears the direct cost of returning goods after a statutory change-of-mind cancellation where New kenshi properly informed the consumer before the purchase that the consumer would be responsible for that cost, unless New kenshi agreed to bear it.
The consumer must take reasonable care of the goods before returning them.
The consumer may inspect the goods in a manner reasonably necessary to establish their nature, characteristics and functioning.
Where permitted by law, the consumer may be liable for diminished value resulting from handling beyond what is necessary for that purpose.
11.4) Exceptions to the Cancellation Right
The statutory cancellation right does not apply to contracts or goods covered by an applicable legal exception.
Depending on the circumstances, exceptions may include personalised or made-to-order goods, rapidly perishable goods, sealed goods that are not suitable for return for health-protection or hygiene reasons after unsealing, and goods that become inseparably mixed with other items after delivery.
These statutory exceptions do not remove remedies for goods that are faulty or otherwise fail to conform to the sales contract.
11.5) Faulty Goods — First 30 Days
If goods fail to conform to the sales contract during the applicable short-term period, the Consumer Rights Act 2022 gives the consumer a short-term right to terminate the contract, subject to the statutory requirements.
The applicable period generally lasts 30 days beginning at the relevant statutory time, which will normally be delivery or, where applicable, completion of an installation or other action required by the trader to enable use of the goods.
The consumer may choose repair or replacement instead of exercising that short-term right.
11.6) Faulty Goods — After 30 Days
After the short-term termination period, a consumer with a valid lack-of-conformity claim may generally choose between repair and replacement, subject to the statutory rules concerning impossibility and disproportionate cost.
The remedy must be provided free of charge, within a reasonable time and without significant inconvenience.
A proportionate reduction in price or final termination of the sales contract may become available in circumstances specified by the Consumer Rights Act 2022, including where the trader has failed to bring the goods into conformity or the lack of conformity is sufficiently serious.
11.7) One-Year Presumption and Longer-Term Rights
Where a lack of conformity becomes apparent within the first year after delivery, Irish consumer law generally provides a presumption, subject to the applicable statutory conditions, that the lack of conformity existed when the goods were supplied unless the trader proves otherwise or the presumption is incompatible with the nature of the goods or the lack of conformity.
After that period, the consumer may be required to establish that the problem results from a lack of conformity that existed when the goods were supplied rather than from normal wear, misuse or accidental damage.
Irish consumers may seek remedies for faulty goods for up to six years in appropriate circumstances. This does not mean that every product has a six-year guarantee or that every fault occurring within six years is automatically covered. The nature of the goods, their expected durability, the cause of the fault and applicable limitation rules remain relevant.
11.8) Delivery
Unless another delivery period has been agreed, goods must be delivered without undue delay and no later than 30 days after conclusion of the sales contract.
Where delivery does not occur on time, the consumer may have statutory rights to require delivery within an additional appropriate period and, if delivery still does not occur, to terminate the contract.
In circumstances provided by law, including where delivery by a particular date was essential or the trader has refused to deliver, the consumer may be entitled to terminate without first granting an additional period.

Use of this form is optional. A consumer may exercise the statutory cancellation right by sending any other clear statement communicating the decision to cancel before the applicable deadline expires.
11.10) Cross-Border Rights
Because NOITAKY Matthieu is established in France and supplies consumers in Ireland, the transaction may constitute a cross-border consumer contract within the European Union.
Nothing in this policy deprives an Irish consumer of mandatory consumer protections applicable under Irish or European Union law that cannot lawfully be excluded through a choice-of-law or contractual provision.

If an eligible cross-border dispute remains unresolved, an Irish consumer may seek assistance from ECC Ireland and, where appropriate, may use an authorised ADR body or the European Small Claims Procedure.
