Terms and Conditions of Sale (TCS)

1) Scope of Application
These Terms and Conditions of Sale (TCS) govern sales made through the website Kenshi Blades, operated by NOITAKY Matthieu, with its registered office at 17 rue de l'Amazone, 44470 Carquefou, France.
These TCS apply to orders placed by customers in United States, United Kingdom, Canada, Australia, New Zealand. and form part of the contract between the customer and NOITAKY Matthieu.
Before placing an order, the customer is given access to these TCS and the information required by applicable consumer law. By ticking the acceptance box where provided and activating the button that clearly indicates that the order involves an obligation to pay, the customer confirms acceptance of the applicable contractual terms.
Before submitting the order, the customer has the opportunity to review the products selected, quantities, prices, delivery information and other order details and to correct any errors.
After the order is placed, an order confirmation and the relevant contractual information are provided electronically on a durable medium where required by applicable law.
The version of the TCS applicable to an order is the version in force when that order is placed. Customers may save or print these TCS for their records.
2) Products
Products offered for sale are described and presented as accurately as reasonably possible. The main characteristics of each product are provided before the order is placed.
Images and visual representations are intended to represent the products faithfully. Minor differences in colour, finish, texture, materials or appearance may occur where they do not affect the product's conformity with the sales contract.
Kenshi Blades may modify the selection of products offered for future orders at any time. Such changes do not alter the characteristics or contractual obligations applicable to an order already concluded.
Goods supplied to consumers must comply with the conformity requirements imposed by the Consumer Rights Act 2022 and other mandatory Irish or European Union consumer legislation where applicable.
3) Prices
For customers in Ireland, prices are displayed in euros (EUR), unless another currency is expressly displayed and agreed before the order is placed.
All prices include all applicable taxes, including VAT, that are required to be included in the advertised or displayed price.
The customer will be shown the total price payable before confirming the order, including the price of the products, applicable taxes and any unavoidable additional charges known at that stage.
Delivery is free in the countries served by Kenshi Blades, unless a different delivery charge is expressly displayed before the customer submits the order.
No undisclosed charge imposed by Kenshi Blades will be added after the order has been placed.
Kenshi Blades may change its prices for future orders at any time. Products will be charged at the price displayed and accepted when the order is submitted, except where a clear and obvious pricing or technical error has occurred and applicable law permits the order not to be fulfilled at that erroneous price.
4) Order
The customer selects the desired products and adds them to the basket. Before submitting the order, an order summary displays the main product details, quantities, prices, delivery charges where applicable and the total amount payable.
The customer must ensure that the billing, delivery and contact information supplied is accurate and complete.
The order is received once it has been submitted and payment has been authorised or confirmed as required by the selected payment method. An electronic confirmation is then sent to the customer.
Kenshi Blades may refuse or cancel an order on legitimate grounds, including suspected fraud, payment failure, product unavailability, a manifest pricing error or another lawful reason. Where an order that has already been paid is validly cancelled by Kenshi Blades, the affected payment will be refunded.
Nothing in this section limits mandatory rights relating to contract formation, unfair commercial practices or consumer remedies.
5) Payment
Payment is due when the order is placed unless another payment arrangement is expressly offered at checkout.
Accepted payment methods are those displayed on the website or at checkout and may include credit or debit cards, PayPal, Klarna, Apple Pay, Google Pay or other available methods.
Payment transactions are processed through secure payment service providers using appropriate security measures. Full payment-card details are not ordinarily stored directly on Kenshi Blades website servers.
Payment providers may perform authentication, fraud-prevention and regulatory checks in accordance with their own terms and applicable law.
6) Delivery
Delivery is free, with no minimum purchase amount, to all countries we serve: United States, United Kingdom, Canada, Australia, New Zealand. (basket total after discounts).
Products are normally processed within 2 to 3 business days following payment confirmation. Typical delivery times are 4 to 8 business days from dispatch. The estimated total delivery time is 7 to 10 business days.
Any delivery period expressly displayed and agreed as part of the order applies to the sales contract.
Unless another delivery period has been agreed, goods will be delivered without undue delay and no later than 30 days after the sales contract is concluded.
If the goods are not delivered within the agreed period or the applicable statutory period, the customer may normally request delivery within an additional period appropriate to the circumstances.
If delivery is still not completed within that additional period, the consumer may terminate the sales contract in accordance with the Consumer Rights Act 2022.
An additional period does not have to be provided where applicable law allows immediate termination, including where Kenshi Blades has refused to deliver or where delivery by the agreed date was essential and the relevant statutory conditions are satisfied.
Products are delivered to the address provided during checkout. If delivery fails because the customer supplied an incorrect or incomplete address, reasonable additional delivery costs may be charged to the customer to the extent permitted by law.
Where delivery is arranged by Kenshi Blades, the risk of accidental loss or damage generally remains with Kenshi Blades until the customer, or a third party nominated by the customer other than the carrier, takes physical possession of the goods.
7) Receipt and Conformity
The customer is encouraged to check the condition of the parcel and goods promptly after receipt and to report any missing, damaged, incorrect or non-conforming product to contact@kenshi-blades.com as soon as reasonably possible.
Where reasonably available, photographs or videos may be requested to help identify and resolve the issue.
Any request to report visible damage within 48 hours is an administrative recommendation intended to facilitate investigation with the carrier. It does not shorten, remove or replace any mandatory statutory consumer right or legal claim period.
Original packaging is not an absolute condition for exercising a statutory remedy relating to faulty or non-conforming goods.
8) Right to Cancel and Return
For eligible distance contracts concluded online, an Irish consumer generally has a statutory right to cancel the contract without giving a reason within 14 days after acquiring physical possession of the goods.
For orders containing multiple goods delivered separately, multiple lots or pieces, or regular delivery of goods, the starting date of the cancellation period is determined in accordance with the Consumer Rights Act 2022.
To exercise the cancellation right, the customer must notify Kenshi Blades before the applicable cancellation period expires by sending an unequivocal statement to contact@kenshi-blades.com. The model cancellation form contained in Section 20 may also be used, but its use is not compulsory.
After notifying cancellation, the customer must return or hand over the goods without undue delay and no later than 14 days after informing Kenshi Blades of the decision to cancel.
The customer may inspect and handle the goods only to the extent reasonably necessary to establish their nature, characteristics and functioning. Where permitted by law, the customer may be responsible for diminished value resulting from handling beyond what is necessary for that purpose.
The direct cost of returning goods following a statutory change-of-mind cancellation is borne by the customer where the customer was properly informed before purchase that those costs would be their responsibility, unless Kenshi Blades has agreed to bear them.
Following a valid statutory cancellation, Kenshi Blades will reimburse all payments required by law, including the cost of the least expensive standard delivery option offered, without undue delay and no later than 14 days after being informed of the cancellation.
Unless Kenshi Blades has offered to collect the goods, reimbursement may be withheld until the goods have been received back or the customer supplies evidence that they have been returned, whichever occurs first.
The statutory cancellation right is subject to the exceptions provided by law. Depending on the circumstances, these may include goods made to the customer's specifications or clearly personalised, goods liable to deteriorate rapidly, sealed goods unsuitable for return for health-protection or hygiene reasons once unsealed, and goods inseparably mixed with other items after delivery.
These change-of-mind exceptions do not restrict remedies relating to faulty, damaged, unsafe, incorrectly supplied or otherwise non-conforming goods.
9) Faulty, Defective or Non-Conforming Products
Irish consumers benefit from the mandatory remedies provided by the Consumer Rights Act 2022 where goods fail to conform to the sales contract.
Short-Term Right to Terminate
If goods are not in conformity with the sales contract at the relevant time, the consumer may have a short-term right to terminate the contract.
Subject to the statutory conditions, this right generally expires 30 days after the relevant starting point, normally delivery of the goods or, where applicable, completion of installation or another action required to enable the consumer to use them.
Where the short-term right is available, the consumer may instead choose repair or replacement if preferred, subject to the statutory rules concerning impossibility and disproportionate cost.
Repair or Replacement
Where the consumer chooses to have goods brought into conformity, the consumer may generally choose between repair and replacement unless the chosen option is impossible or would impose disproportionate costs compared with the alternative remedy.
Repair or replacement must be carried out free of charge, within a reasonable time and without significant inconvenience to the consumer.
Kenshi Blades will bear the necessary costs associated with a statutory repair or replacement where required by law.
Price Reduction or Final Termination
Depending on the circumstances, the consumer may be entitled to a proportionate reduction in price or a final right to terminate the sales contract where repair or replacement is unavailable, unsuccessful, not carried out within a reasonable time or without significant inconvenience, or where the lack of conformity is sufficiently serious.
The final right to terminate does not apply where the lack of conformity is minor, as provided by applicable law.
Burden of Proof
Where a lack of conformity becomes apparent within 12 months from the relevant time, it is generally presumed to have existed at that time unless the contrary is proven or the presumption is incompatible with the nature of the goods or the lack of conformity.
This presumption does not prevent a consumer from pursuing a remedy after the first 12 months where a statutory claim remains available.
Irish consumers may seek remedies for faulty goods for up to six years in appropriate circumstances. This does not constitute an automatic six-year guarantee for every product. The nature and expected durability of the goods, the cause of the problem and the applicable limitation rules remain relevant.
Requests relating to faulty or non-conforming goods may be sent to contact@kenshi-blades.com with the order number, a description of the issue and, where reasonably available, supporting photographs or videos.
10) Refund Policy
Refunds are made using the same payment method used for the original transaction unless the customer expressly agrees otherwise and does not incur any fee as a result.
For a statutory online cancellation, reimbursement will be handled in accordance with the deadlines and conditions described in Section 8.
Where a refund is due for faulty or non-conforming goods, it will be handled in accordance with the applicable remedies and reimbursement requirements of the Consumer Rights Act 2022.
No refusal of refund based on packaging, condition, reporting time or another contractual requirement applies where it would unlawfully restrict a mandatory consumer remedy.
For a statutory change-of-mind cancellation, a lawful deduction may be made for diminished value caused by handling beyond what is reasonably necessary to establish the nature, characteristics and functioning of the goods.

11) Product Availability
Products are offered subject to availability.
If a product becomes unavailable after an order has been placed, the customer will be informed as soon as reasonably possible.
Depending on the circumstances, the customer may be offered the choice to:
wait for the product to become available, where appropriate,
accept another solution expressly agreed with Kenshi Blades,
or receive a full refund of the amount paid for the unavailable product.
No substitute product will be imposed without the customer's agreement.
12) Liability
Kenshi Blades is not responsible for damage caused solely by misuse, accidental damage, unauthorised modification, improper installation or use contrary to the product's intended purpose or applicable instructions, except where liability cannot lawfully be excluded or restricted.
Limitation of Liability
Any exclusion or limitation of liability in these TCS applies only to the extent permitted by Irish, French and applicable European Union law.
Kenshi Blades is not responsible for losses that were not reasonably foreseeable as a consequence of a breach, or for business losses incurred by a customer acting exclusively as a consumer, to the extent such exclusions are lawful.
Website access may occasionally be interrupted for maintenance, updates, security measures, hosting incidents or circumstances outside our reasonable control.
Despite reasonable efforts, website content may occasionally contain technical, typographical, pricing or description errors. A manifest error will be corrected and any affected order will be handled in accordance with applicable contract and consumer law.
Minor differences in colour or visual appearance resulting solely from screen settings, lighting or normal product variation are not defects where the goods otherwise conform to the sales contract.
Links to independent third-party websites may be provided for convenience. Kenshi Blades does not control their content, privacy practices or availability.
Nothing in these TCS excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability, statutory right or consumer remedy that cannot lawfully be excluded or limited.
Any event outside the reasonable control of Kenshi Blades will be assessed in accordance with applicable law and does not automatically remove rights that the consumer is entitled to exercise under mandatory legislation.
13) Personal Data
Personal data is processed for purposes including order management, payment, delivery, customer service, fraud prevention and compliance with legal obligations.
Personal data is processed in accordance with the EU General Data Protection Regulation (GDPR), the French Data Protection Act and, where applicable to customers or processing activities in Ireland, the Irish Data Protection Act 2018 and other applicable data-protection rules.
Depending on the applicable circumstances, individuals may have rights of access, rectification, erasure, restriction, objection, data portability and withdrawal of consent.

14) Consumer Complaints and Dispute Resolution
Customers are encouraged to contact Kenshi Blades first at contact@kenshi-blades.com so that we can investigate and attempt to resolve any complaint amicably.
Irish consumers may obtain independent information about their consumer rights from the Competition and Consumer Protection Commission (CCPC).

Because NOITAKY Matthieu is established in France, an Irish consumer who has already complained to Kenshi Blades and has not been able to resolve an eligible cross-border dispute may seek assistance from European Consumer Centre Ireland (ECC Ireland).

Where applicable, the customer may also use an appropriate Alternative Dispute Resolution (ADR) body. If NOITAKY Matthieu is legally required or has expressly agreed to participate in a particular ADR procedure, the relevant information will be provided in accordance with applicable law.
For qualifying cross-border civil or commercial claims within the European Union, the European Small Claims Procedure may be available for claims up to €5,000, excluding interest and expenses.
Nothing in this section prevents a consumer from bringing proceedings before a competent court where permitted by applicable law.
15) Applicable Law and Jurisdiction
These TCS are governed by French law, subject to mandatory European Union conflict-of-law rules.
Where Kenshi Blades directs its commercial activities to Ireland and the conditions of Article 6 of Regulation (EC) No 593/2008 (Rome I) are satisfied, the choice of French law does not deprive an Irish consumer of the protection afforded by mandatory provisions of the law that would apply in the absence of that choice.
The parties will first attempt to resolve any dispute amicably by contacting contact@kenshi-blades.com.
Where the consumer-jurisdiction rules of Regulation (EU) No 1215/2012 apply, an Irish consumer may bring proceedings against NOITAKY Matthieu either before the competent courts of the Member State in which NOITAKY Matthieu is domiciled or before the courts for the place where the consumer is domiciled.
Proceedings brought by NOITAKY Matthieu against a consumer are subject to the mandatory jurisdiction rules applicable to consumer contracts.
Nothing in these TCS imposes exclusive French jurisdiction where such a clause would conflict with mandatory rules protecting the consumer.
16) Termination – Cancellation – Suspension
By the seller:
Kenshi Blades may refuse or cancel an order, or suspend or close a customer account, where there is a lawful and legitimate reason, including non-payment, fraud or suspected fraud, abusive or unlawful activity, product unavailability, a manifest pricing or description error, or a material breach of these TCS.
Customers will be informed where appropriate, and payments relating to goods that will not be supplied will be refunded.
By the customer:
Where operationally possible, a customer may request cancellation before the order is dispatched. This contractual possibility is separate from the statutory cancellation rights applicable to eligible distance contracts.
After dispatch or delivery, consumers retain the statutory cancellation and consumer-remedy rights described in these TCS and applicable law.
Effects:
Termination does not affect rights or obligations that arose before termination, including outstanding refunds, returns, payments or legal claims.
Provisions intended by their nature to survive termination, including intellectual-property, liability, data-protection and applicable-law provisions, remain effective to the extent permitted by law.
Nothing in this section affects mandatory statutory consumer rights under Irish or European Union law.
17) Modifications to the TCS – Notification
Kenshi Blades may update these TCS for future orders to reflect legal, technical, operational or commercial changes.
The applicable version is the version made available to and accepted by the customer when the relevant order is placed.
Orders already concluded remain governed by the contractual terms applicable when they were placed, except where a change is required by mandatory law and applies to existing contracts.
Material changes affecting future use of the website may be communicated through the website, email or another appropriate method where required.
18) Intellectual Property
All content on Kenshi Blades, including texts, descriptions, photographs, videos, visual elements, logos, trademarks, graphic design, structure, code and databases, is protected by applicable intellectual-property law and belongs to Kenshi Blades, NOITAKY Matthieu or the relevant rights holder.
Any unauthorised reproduction, modification, adaptation, translation, extraction, reuse or distribution, in whole or in part, is prohibited except where permitted by applicable law.
Customers receive a limited, personal and non-commercial right to access and use the website for browsing and purchasing products.
Product photographs, descriptions and other protected website content may not be reused on another website, marketplace or platform without appropriate permission.
Where a customer voluntarily publishes content such as a review, photograph or comment and has the necessary rights to that content, the customer grants Kenshi Blades a non-exclusive, royalty-free licence to use, reproduce and adapt that content for purposes connected with the website and its promotion, subject to applicable intellectual-property, privacy and data-protection rights.

20) Additional Mandatory Consumer Terms — Ireland
Market-specific provisions effective: 22/08/2026
This Section 20 applies to customers acting as consumers whose delivery address is in Ireland. It forms an integral part of these TCS.
Nothing in these TCS excludes, restricts or modifies any consumer right, guarantee, remedy or liability that cannot lawfully be excluded, restricted or modified under Irish or applicable European Union law.
If any provision conflicts with a mandatory consumer rule, the mandatory rule prevails to the extent of that conflict and the remaining provisions continue to apply.
Any request to report a problem within 48 hours, provide photographs, retain original packaging or follow another administrative procedure is intended to assist with efficient claim handling. It does not reduce a mandatory statutory consumer right.
20.1) Pre-Contract Information and Order Confirmation
Before an online order is submitted, consumers will be provided with the information required by applicable law, including the trader's identity and contact details, the main characteristics of the goods, the total price including applicable taxes and unavoidable charges, payment arrangements, delivery arrangements, complaint procedures and information concerning the statutory cancellation right where applicable.
The customer will have an opportunity to identify and correct input errors before submitting the order.
Where required, confirmation of the concluded contract and the applicable contractual information will be provided on a durable medium.
20.2) Statutory 14-Day Cancellation Right
Under the Consumer Rights Act 2022, a consumer may cancel an eligible distance contract without giving a reason before the applicable cancellation period expires.
For an ordinary sales contract for goods, the cancellation period generally expires 14 days after the day on which the consumer, or a person nominated by the consumer other than the carrier, acquires physical possession of the goods.
For multiple goods delivered separately, multiple lots or pieces, and regular deliveries during a defined period, the applicable starting point is determined under the Consumer Rights Act 2022.
The consumer may exercise the right by sending an unequivocal cancellation statement to contact@kenshi-blades.com or by using the model form below.
The communication is made in time if it is sent before the cancellation period expires.
Following cancellation, the consumer must return the goods without undue delay and no later than 14 days after notifying Kenshi Blades.
The consumer bears the direct return cost where properly informed of that obligation before purchase, unless Kenshi Blades has agreed to bear the cost.
Kenshi Blades will reimburse the amounts required by law, including the least expensive standard delivery cost offered for the original purchase. Supplementary delivery costs arising from the customer's choice of a more expensive delivery method are not required to be reimbursed.
Unless Kenshi Blades has offered to collect the goods, reimbursement may be withheld until the goods are received or the consumer provides evidence that they have been sent back, whichever occurs first.

Use of this form is optional. Any other unequivocal statement communicating the decision to cancel may be used.
20.3) Faulty or Non-Conforming Goods
Goods supplied to Irish consumers must satisfy the applicable subjective and objective conformity requirements under the Consumer Rights Act 2022.
Among other requirements, goods must correspond with their description, be fit for their ordinary purpose and any particular purpose accepted by the trader, and possess the quality, durability, functionality, compatibility, security and other characteristics that the consumer may reasonably expect in the circumstances.
Where goods are not in conformity with the sales contract, the consumer has the remedies provided by law.
20.4) First 30 Days
Subject to the statutory conditions, an Irish consumer has a short-term right to terminate the sales contract where goods are not in conformity with the contract.
This short-term right generally expires 30 days after the relevant statutory starting point.
The consumer may choose repair or replacement rather than termination if preferred, subject to the statutory conditions.
20.5) Repair, Replacement, Price Reduction and Final Termination
The consumer may generally choose between repair and replacement unless the chosen remedy is impossible or would impose disproportionate costs compared with the alternative.
Repair or replacement must be carried out free of charge, within a reasonable time and without significant inconvenience to the consumer.
Where the statutory conditions are satisfied, including where repair or replacement is unsuccessful, unavailable or inappropriate, the consumer may have a right to a proportionate reduction in price or final termination of the sales contract.
A final right to terminate does not apply where the lack of conformity is minor.
Additional repair or spare-part rights may apply to certain categories of products where specific Irish or European Union repair legislation applies.
20.6) Burden of Proof and Duration of Rights
If a lack of conformity becomes apparent within 12 months after the relevant time, the lack of conformity is generally presumed to have existed when the goods were supplied unless the contrary is proven or the presumption is incompatible with the nature of the goods or the fault.
After that period, the fact that the presumption no longer applies does not automatically end the consumer's rights.
Depending on the product and circumstances, Irish consumers may pursue remedies for faulty goods for up to six years. This is not an automatic six-year product warranty and does not cover normal wear and tear, accidental damage or misuse.
20.7) Delivery and Risk
Unless another period has been agreed, goods must be delivered without undue delay and no later than 30 days after conclusion of the sales contract.
If delivery does not occur on time, the consumer may have the rights described in Section 6, including the right to require delivery within an appropriate additional period and, where the statutory conditions are met, to terminate the contract.
Where Kenshi Blades arranges delivery, risk generally remains with Kenshi Blades until the consumer or a nominated third party other than the carrier takes physical possession of the goods.
20.8) Cross-Border Consumer Protection and Disputes
NOITAKY Matthieu is established in France and supplies consumers in Ireland. Accordingly, an order may constitute a cross-border consumer contract within the European Union.
A choice of French law does not deprive an Irish consumer of mandatory protection available under the law applicable pursuant to Article 6 of Regulation (EC) No 593/2008.
Where Regulation (EU) No 1215/2012 applies, an Irish consumer may bring proceedings against NOITAKY Matthieu either before the competent courts of the Member State where NOITAKY Matthieu is domiciled or before the courts for the place where the consumer is domiciled.
Consumers should first contact Kenshi Blades at contact@kenshi-blades.com so that an amicable solution can be attempted.
An eligible Irish consumer with an unresolved dispute involving NOITAKY Matthieu may seek assistance from ECC Ireland. The European Small Claims Procedure may also be available for qualifying cross-border claims up to €5,000, excluding interest and expenses.
