Purpose

This page explains the statutory consumer rights and commercial warranty applicable to products sold on New kenshi and delivered to Ireland, together with the conditions and procedure for making a claim.

1) Statutory Consumer Rights — Ireland

Consumer Rights Act 2022

Consumers in Ireland benefit from mandatory rights under the Consumer Rights Act 2022 where that legislation applies.

Goods supplied under a consumer sales contract must conform to the contract. Among other requirements, goods must:

  • Match the description, type, quantity and quality agreed with the consumer;
  • Be fit for the purposes for which goods of the same type would normally be used;
  • Be fit for any particular purpose made known to and accepted by the trader where applicable;
  • Possess the durability, functionality, compatibility, security and other qualities that a consumer may reasonably expect, taking account of the nature of the goods and relevant public statements;
  • Correspond to any relevant sample or model made available before purchase;
  • Be supplied with the accessories, packaging, installation instructions and other instructions that the consumer may reasonably expect.

Faults identified within 30 days

If goods do not conform to the sales contract and the statutory conditions are satisfied, the consumer may have a short-term right to terminate the sales contract during the first 30 days and obtain a refund.

Instead of exercising that short-term right, the consumer may choose repair or replacement, subject to the statutory rules concerning impossibility and disproportionate cost.

Faults identified after 30 days

After the short-term 30-day period, a consumer with a valid lack-of-conformity claim may normally choose between repair and replacement, unless the chosen remedy is impossible or would impose disproportionate costs compared with the alternative remedy.

A statutory repair or replacement must be carried out free of charge, within a reasonable time and without significant inconvenience to the consumer.

Where repair or replacement is unavailable, unsuccessful, not completed within a reasonable time, causes significant inconvenience, or where the lack of conformity is sufficiently serious, the consumer may be entitled to a proportionate reduction in price or to terminate the sales contract in accordance with applicable law.

These statutory remedies are separate from and additional to the New kenshi commercial warranty described below.

2) New kenshi Commercial Warranty (Lifetime warranty)

In addition to all mandatory statutory consumer rights, New kenshi provides a commercial warranty lasting Lifetime warranty, starting from the purchase date shown on the invoice.

What is covered

  • Manufacturing defects affecting the proper functioning, assembly or structure of the product;
  • Material or component defects arising during normal and intended use;
  • Abnormal or premature deterioration that can reasonably be attributed to a manufacturing or material defect;
  • Other faults that can reasonably be shown to have resulted from a manufacturing defect rather than normal wear, accidental damage or misuse.

What is not covered

  • Normal wear and tear or deterioration reasonably resulting from ordinary use over time;
  • Accidental damage, impact, dropping or misuse of the product;
  • Use contrary to the product's intended purpose, instructions or applicable safety guidance;
  • Improper installation, cleaning, maintenance or storage by the customer;
  • Unauthorised modification, dismantling or repair;
  • Damage caused by external conditions for which the product was not designed;
  • Products not purchased through New kenshi or commercial-warranty claims for which reasonable proof of purchase cannot be provided.

These exclusions apply only to the extent that the excluded event caused or materially contributed to the issue. They do not exclude or limit any mandatory statutory remedy that applies independently under Irish consumer law.

Duration

The commercial warranty lasts Lifetime warranty from the purchase date shown on the New kenshi invoice.

Repair or replacement under the commercial warranty does not extend or renew the original commercial-warranty period unless applicable law requires otherwise or New kenshi expressly agrees otherwise in writing.

The expiry of the Lifetime warranty commercial warranty does not automatically mean that all statutory consumer rights have expired.

3) Eligibility Conditions

To make a claim under the New kenshi commercial warranty, the following conditions normally apply:

  • The product was purchased through New kenshi;
  • The product was used properly and for its intended purpose;
  • Reasonable proof of purchase is available, such as the order number or invoice;
  • The issue is reported as soon as reasonably possible after discovery;
  • Clear photographs or videos are supplied where reasonably available and useful for assessing the issue.

These conditions relate to the additional commercial warranty. A procedural condition does not restrict or remove a mandatory statutory consumer right where Irish or other applicable law does not permit such a restriction.

4) Claim Procedure

  1. Send an email to contact@kenshiblades.com with the subject line: “Warranty – order number”.
  2. Include:
    • Your order number;
    • The purchase date;
    • A detailed description of the issue or defect;
    • The date on which the issue first appeared.
  3. Attach, where reasonably available:
    • Photographs or videos showing the complete product;
    • Close-up photographs or videos clearly showing the issue.

We aim to provide an initial response within 48 business hours with appropriate instructions, which may include further diagnosis, provision of a replacement part, repair, replacement, return or another appropriate remedy.

This prior-contact requirement is intended to prevent products from being sent to the wrong warehouse and to facilitate efficient processing. It does not remove, delay or restrict a mandatory statutory right or remedy.

5) Solutions Provided

Subject to the consumer's applicable statutory rights, the commercial-warranty conditions and the nature of the issue, the available solutions may include:

  1. Repair or provision of a replacement part where reasonably appropriate;
  2. Replacement with an identical product or, where the original model is unavailable, an appropriate equivalent product;
  3. A proportionate reduction in price, partial refund or full refund where appropriate;
  4. Another remedy required by applicable consumer law.

Transport Costs

If a claim is covered by the commercial warranty, New kenshi covers reasonable return and reshipping costs in accordance with the instructions provided by customer service.

Where goods are being repaired or replaced under a mandatory statutory remedy, the remedy will be provided free of charge where required by the Consumer Rights Act 2022, including necessary postage, carriage, labour or material costs.

If the customer incurs an authorised expense that New kenshi is required to reimburse, proof of payment should be sent to contact@kenshiblades.com together with the order number and claim reference.

A parcel returned without prior contact or to an address not provided by customer service may experience processing delays where legally permitted.

If the issue is not covered by either the commercial warranty or a mandatory statutory consumer right, New kenshi may nevertheless offer an alternative solution at its discretion.

6) Product Damaged Upon Delivery

Please report a missing or damaged product to contact@kenshiblades.com as soon as reasonably possible and, where available, include photographs or videos of the product and packaging.

We recommend reporting visible delivery damage within 48 hours so that the carrier investigation can begin promptly. This requested reporting period is an administrative recommendation only and does not reduce, replace or shorten any mandatory statutory consumer right or legal claim period.

Depending on the circumstances and applicable law, the appropriate solution may include repair, replacement, provision of a replacement part, a price reduction, termination of the sales contract or a refund.

The return address is not necessarily the company's registered office. The correct address will be provided by customer service after the case has been reviewed.

7) Territorial Scope

The New kenshi commercial warranty applies to eligible orders delivered to United States, United Kingdom, Canada, Australia, New Zealand..

For consumers in Ireland, mandatory rights available under the Consumer Rights Act 2022 and other applicable Irish and European Union consumer legislation apply independently of this commercial warranty.

Because NOITAKY Matthieu is established in France, applicable French and European Union rules may also govern aspects of the transaction. Nothing in this policy deprives an Irish consumer of mandatory consumer protection that applies to the transaction and cannot lawfully be excluded by contract.

The expiry of the commercial warranty does not remove a statutory right that remains available under applicable law.

The commercial guarantee statement and its applicable conditions will be made available in clear and intelligible language and, where required by applicable law, provided on a durable medium no later than delivery of the goods.

9) Complaints and Dispute Resolution

If a warranty complaint cannot be resolved directly with New kenshi, an Irish consumer may use any competent consumer-information service, alternative dispute-resolution body, court or other procedure available under applicable law.

The CCPC provides information about consumer rights in Ireland and publishes information about authorised alternative dispute-resolution bodies.

European Consumer Centre Ireland (ECC Ireland)

Because NOITAKY Matthieu is established in France, an Irish consumer who has first complained directly to New kenshi and has been unable to resolve the issue may be able to seek assistance from ECC Ireland in relation to the cross-border EU dispute.

Where applicable, consumers may also consider an authorised ADR body or the European Small Claims Procedure for eligible cross-border claims.

Use of an ADR procedure does not prevent a consumer from exercising a right to bring a claim before a competent court where applicable.

10) Additional Mandatory Consumer Rights — Ireland

10.1) Conformity of Goods

Under the Consumer Rights Act 2022, goods supplied to an Irish consumer must conform to the sales contract and satisfy the applicable subjective and objective conformity requirements.

This includes requirements relating to description, quality, fitness for normal and agreed purposes, quantity, durability, functionality, compatibility, security, accessories, instructions and other characteristics that the consumer may reasonably expect in the circumstances.

10.2) Short-Term 30-Day Right to Terminate

Where goods fail to conform to the sales contract at the relevant time, an Irish consumer may, subject to the statutory conditions, exercise the short-term right to terminate the sales contract.

This right generally expires 30 days after the relevant statutory starting point, which will normally be delivery of the goods, or completion of installation or another action required by the trader to enable use of the goods where applicable.

Where this right is validly exercised, the consumer may obtain reimbursement in accordance with the Consumer Rights Act 2022.

The consumer may instead choose repair or replacement if preferred, subject to the applicable statutory conditions.

10.3) Repair or Replacement

Where the consumer chooses to have non-conforming goods brought into conformity, the consumer may generally choose between repair and replacement.

The chosen remedy may be unavailable where it is impossible or, compared with the alternative, would impose disproportionate costs on the trader taking account of the circumstances specified by law.

A statutory repair or replacement must be provided free of charge, within a reasonable time and without significant inconvenience to the consumer.

10.4) Price Reduction or Final Termination

Depending on the circumstances, the consumer may be entitled to a proportionate reduction in price or to finally terminate the sales contract where repair or replacement has been refused, has not been properly completed, the lack of conformity persists, the problem is sufficiently serious, or it is clear that conformity will not be restored within a reasonable time or without significant inconvenience.

A final right to terminate may not apply where the lack of conformity is minor, as provided by applicable law.

10.5) Duration of Statutory Rights

The Lifetime warranty commercial-warranty period must not be confused with the duration of statutory consumer rights.

Depending on the nature of the goods and the circumstances, a consumer may be able to seek a statutory remedy for a faulty product for considerably longer than the commercial-warranty period. Irish consumer guidance recognises that a trader may have responsibility for a faulty product for up to six years after purchase where the goods could reasonably be expected to last that long under normal use.

This does not mean that every product has an automatic six-year warranty. Whether a statutory claim remains available depends on the circumstances, including the nature of the goods, their expected durability, the cause of the problem and applicable limitation rules.

10.6) Commercial Guarantees

The Lifetime warranty commercial warranty is binding on NOITAKY Matthieu in accordance with its stated conditions and any applicable associated advertising.

The commercial warranty does not replace the trader's legal obligation to supply goods in conformity with the sales contract.

The commercial guarantee statement will identify the guarantor, explain the procedure for making a claim, identify the goods covered and state the applicable conditions.

Failure to comply with a formal requirement concerning the commercial guarantee statement does not, where the Consumer Rights Act 2022 so provides, remove the binding nature of the commercial guarantee.

10.7) No Exclusion of Mandatory Rights

A commercial guarantee cannot lawfully be used to exclude or limit statutory consumer rights.

Requirements concerning photographs, prior contact, original packaging, proof of purchase, return authorisation or other procedures apply only to the extent that they are lawful and do not make the exercise of mandatory consumer rights subject to an impermissible restrictive or onerous condition.

Normal wear, misuse or accidental damage may fall outside the commercial warranty where those circumstances caused the problem, but such exclusions do not affect an unrelated statutory defect that is independently covered by law.

10.8) Complaints and Cross-Border Redress

Consumers should first contact New kenshi at contact@kenshiblades.com so that we can investigate and attempt to resolve the complaint directly.

Irish consumers may obtain consumer-rights information from the Competition and Consumer Protection Commission.

As NOITAKY Matthieu is established in France, eligible Irish consumers may also seek assistance from ECC Ireland for unresolved cross-border disputes with the trader.

Where the applicable conditions are met, the European Small Claims Procedure may be available for cross-border claims of up to €5,000 against a business established in another EU Member State.
